08/22/2024 - Azhar & Azhar Law Firm Secures Citizenship for Client Despite Theft Charge

Client was charged with theft in March of 2022 for having received stolen property. Although the crime would have ordinarily prevented client from securing citizenship for 5 years, Attorney Noaman Azhar was able to successfully convince USCIS that no conviction took place. Citing the relevant case law, Mr. Azhar argued that no adjudication of guilt occurred because the client completed a pre-trial diversion program, did not plead guilty, and successfully passed a polygraph test. On August 22, 2024 USCIS mailed out an oath ceremony notice for client. Client will now naturalize and upgrade his wife’s visa application from spouse of a permanent resident to spouse of a U.S. citizen – saving approximately 2 years in processing time.

09/09/2024 - Azhar & Azhar Law Firm Secures Approvals for two I-290B Motions to Re-Open

In April of 2024 USCIS denied two separate cases due to USCIS administrative errors. In both cases, the applicant did not attend their scheduled adjustment of status interview. Attorney Noaman Azhar filed an I-290B motion to re-open each case arguing that USCIS failed to mail out interview notices to the applicant and the attorney advising them of the interview. During his investigation into the case, Attorney Noaman Azhar learned that in the USCIS internal appointment database system, USCIS had no record that an interview was scheduled. On September 9th and September 3rd, USCIS agreed to re-open each case after being shown their administrative errors.

CASE VICTORY

EB-1A I-140 Approved for Senior Physicist in 3D Imaging Technology

Our office filed an EB-1A petition for our client, where we argued that our client had extraordinary ability and achievement in the sciences, specifically in the field of seismology and seismic imaging. We were was able to document (awards, publications, peer review, etc.) his international recognition and acclaim for his accomplishments in the field of seismology and seismic imaging. The I-140 was approved without an RFE.

Keeping Family Together Program.

On August 19, 2024 USCIS began accepting applications for the new Parole in Place (PIP) Keeping Families Together program that President Biden first announced in June. The program allows undocumented spouses and stepchildren of U.S. citizens to receive a three-year period to apply for permanent residence (green card) after filing the I-131F form. Azhar & Azhar Law Firm has begun processing these cases for eligible applicants.
