Your mortgage can be current… and your HOA can still foreclose.

That’s the wild reality behind a new New York Post story featuring Kirk Pearson, Managing Partner at LS Carlson Law.

The article highlights a growing crisis: HOA foreclosures are up nearly 40% in just two years as associations across the country deal with rising insurance costs, depleted reserves, and delinquent accounts.

Some of the examples are staggering:
1.One community saw dues jump from $350 to $1,250 per month

2. Homeowners were hit with a $10,000 special assessment

3. One HOA’s insurance premium reportedly climbed from $60,000 to $360,000

Kirk explained to the Post that HOA foreclosure sales are typically auctioned, and in California, homeowners may only have a limited window to recover their property.

But what makes these cases even more alarming is that the missed dues are often just the beginning. Collection fees, legal costs, and aggressive enforcement can turn a manageable issue into a devastating one.

A home is more than four walls—it’s the view, the privacy, and the enjoyment that come with it.

When our clients learned their HOA had approved a neighboring second-story and ADU project that would significantly impact their protected hillside view and create privacy concerns, they felt the process had ignored their rights and their objections.

Our Senior Attorney, Tate Casey, stepped in and conducted a thorough review of the HOA’s approval process and governing documents. After identifying significant procedural issues, he challenged the association’s actions and helped position the matter for a favorable resolution.

The result was a binding settlement that required meaningful corrective measures to address the view and privacy impacts while avoiding the time, expense, and uncertainty of litigation.

Another strong result for homeowners and a reminder that HOA boards must follow their own rules.
