Composite from real files, details changed. The lesson underneath it comes up constantly: the people who write things down can answer questions a year later that nobody else can.

Memory is the first casualty of a long claim. Months in, it is genuinely hard to say which week the headaches started, or which shift got given up, or how many mornings were spent in a waiting room. That is not a character flaw. That is how memory works.

Paper does not get tired. A cheap notebook and one dated line a day — what hurt, what you missed, who you talked to — turns a fog back into a record.

“You will be working with your new adjuster going forward” is a sentence that quietly erases a year of context.

Files change hands constantly. People get promoted, transferred, buried in volume, or move on. It is rarely malice and usually not even a decision — it is a queue.

What it costs is memory. The new person inherits a folder, not a conversation, so the request that was answered in March shows up again in September looking brand new.

So we answer it again, dated and logged, and we keep the copy. Number five will want it too.

A release is the one document in a claim that is written to be permanent.

The word doing the quiet work is “all” — all claims arising from that day, the ones you know about and the ones nobody has found yet. People sign it the way they sign for a package.

Injuries do not finish revealing themselves on the schedule paperwork prefers. So the timing of a release matters at least as much as the wording of one.

Read it. Ask what it closes, and ask what it leaves open.

Every small office has one: the board with the columns, photographed proudly the day it gets drawn, quietly out of date about thirty-six hours later.

Ours is no different. The difference is that it is not what anybody relies on — the actual system is the calendar, the checklists, and the software that nags us, and none of them care whether somebody remembered to pick up a marker.

The whiteboard survives anyway. It is good for thinking out loud, and it is very good for crossing things off.

Some tools are for the work. Some are for the humans doing it.

Late August in Laguna is the last big month of the year for the canyon — festival season winding down, beach days running long, and the 133 doing the whole county's exit interview after dark.

It is two lanes through a canyon with almost nowhere to pull off. Headlights, brake lights, a bend, and the occasional deer with strong opinions about right of way.

One useful habit: give up the tailgate. On a road with no shoulder, following distance is the only escape route there is.

Summer is nearly over. Everybody gets home.

The real answer is that the case moves at the speed of your treatment, not the speed of the paperwork.

Until doctors know whether an injury resolves or sticks around, nobody can describe it accurately — and a claim described too early is a claim described wrong. Every case is different, and some take considerably longer than people expect.

What should be fast: the calls returned, the records requested, the deadlines calendared. That part is on the lawyer, and you should be able to feel it.

Slow because it is being done carefully is fine. Slow because nobody is working it is not — and you are allowed to ask which one you are getting.

"Closed for lack of response" is a sentence that assumes the mail worked.

Sometimes it did not: a move, a forwarding order that expired, a name spelled two different ways in two different systems. The file goes quiet, the quiet gets read as abandonment, and a real claim gets a stamp on it.

It is fixable — but only if somebody notices. Which is the whole argument for having a person whose job is noticing.

Keep every envelope. Even the boring ones.

Nobody reads page nine of the benefits booklet. Page nine is where the health plan explains that when it covers treatment for injuries another driver is responsible for, it can ask to be repaid out of your recovery.

It has a name — reimbursement, or subrogation — and it is contract language, not a trick. It just tends to surface at the end, when people assume the hard part is finished.

So the useful habit is boring: tell whoever is handling your claim exactly who paid each bill — the health plan, the auto policy, you. Early.

Plenty of firms run on volume: thousands of files, a phone tree, each case a ticket number moving through a queue. Nothing wrong with it — that model helps a lot of people. It is just not this office.

We stay small on purpose. When you call, the person who picks up knows your name and your file — and there is a decent chance it is the lawyer. Every open case here fits on one screen, and a person looks at every one of them, every week.

A queue is efficient. Being known is better.

Every mid-August, the same quiet collision: drivers with two months of lighter-street habits, and a county's worth of kids reappearing all at once — the pickup loop, the crossing guard, the water bottle rolling into the street with a seven-year-old right behind it.

One useful fact: California's 25 mph school-zone limit applies whenever children are present — not just when school is in session, not just when a light flashes.

First weeks are the worst weeks. Add three minutes to the drive and give the crosswalks your eyes back.
