Privacy Policy vs. Terms of Use – Why Both Matter
If your business has a website – even a simple one – two key documents should be in place: a Privacy Policy and Terms of Use. They are not the same, and both are essential.
A Privacy Policy explains what personal information you collect, how you use it, and whether you share it with others. If you collect even basic information – line names, emails, payment details, or even technical data such as IP addresses from visitors who don’t sign up – many privacy laws require you to disclose your practices clearly. This includes California law (CalOPPA), which requires most businesses with an online presence to post a Privacy Policy.
Your Terms of Use set the rules for how visitors interact with your site, apps, and social media accounts. They protect your intellectual property, limit your liability, and create expectations if something goes wrong. Depending on what you offer, your Terms may also need to include required consumer disclosures.
While the Privacy Policy is focused on protecting your visitors’ rights, the Terms of Use are focused on protecting your business.
You really need both since one is not a substitute for the other. Once you have them in place, you can (and should) link to them from your website footer, apps. social media profiles, or anywhere else you interact with clients or users online.
