Another client of Burgess and Porter Law set to secure his freedom. At age 16 he was convicted of 1st Degree Murder, without any evidence that he actually committed the killing.

This never happens. Susan Burgess-Farrell got first degree criminal s*xual convictions vacated for our BPLAW client following a meticulously laid out Habeas Corpus petition and evidentiary hearing. Our client will now get the fair trial he should have received in the first place. After years in custody, an innocent man may finally be freed! Way to go Ms. Burgess-Farrell and Investigator Scott Elliott.

September 2018 was a crazy good month for Burgess & Porter Law clients:

1. Through motions to the District Court we were able to get two charges of criminal s*xual pe*******on reduced to one charge of criminal s*xual contact. A week later, we were able to convince the District Attorney to dismiss the case against our client completely, as they were going to lose at trial.

2. In the first week of September, as a result of two Motions to Suppress Evidence, we were able to get all of the evidence in a ma*****na trafficking case excluded and the case dismissed.

3. Susan Burgess-Farrell was able to get four Sandoval County felony offenses dismissed at the preliminary hearing stage.

4. In the second week of September, after a full evidentiary hearing, the Cibola County court suppressed all the evidence in another Interstate-40 ma*****na trafficking case. Case dismissed!

5. We had three families have CYFD return their children and get their cases completely dismissed.

6. Barry Porter successfully argued to the New Mexico parole board to discharge a client from his 20-year parole. Finally and totally free.

7. We successfully convince a Children’s Court Special Master to not take custody of a client’s four-year-old son, following CYFD’s petition for custody.

Definitely our favorite court document. Got a full acquittal on s*x charges in Aztec, New Mexico, and so far 6 dismissal of felony cases in Sandoval County, 4 dismissals of Children's Court cases, and several Nolle Prosequi notices for clients. So far, 2018, shaping up to be another great year for Burgess and Porter Law and our clients!

Barry Porter speaks out for constitutional rights and against plea policies that short cut rights and the search for truth.

At least two attorneys in the District Attorney’s Office appear to be offering hardline plea deals to indigent defendants.
