As always, we conduct discovery, interview all participants, and turn over every stone, before we discuss with a client whether to plea. If a plea is taken, we do our best to mitigate all outcomes with a frank discussion on fines, any possibility of jail, expungements, and probation (to name a few). When cannabis was legalized for recreational use, part of the act required the State to automatically expunge now legal activities, including possession of small amount of cannabis and possession of paraphernalia related to cannabis. The State had time to prepare to do the expungements. We had kept an eye on several clients that should have been expunged but there was no action leading us to believe, New Mexico Department of Public Safety was unlikely to complete the expungements in a reasonable amount of time. In early May of this year, we came across this article that confirmed our suspicions. The article, https://www.krqe.com/news/marijuana/cannabis-expungement-in-new-mexico-not-quite-automatic-for-everyone-after-new-law/ confirmed that only "simple" cannabis expungements would be conducted. Simple in this context meaning that was the only charge in the criminal citation or complaint. Unfortunately, that is rarely the case, and with this new legislation it is now up to the individual to petition the court to expunge the cannabis related charges from the rest of the case. While the expungement will still be granted, the process has become more complicated for the individual. We will keep an eye out for the portal that is being created for people to challenge the more complex cases. There are also other methods we can use to fully expunge certain cases.
