New Mexico Father’s Rights

New Mexico law recognizes that it is in the best interests of children to have frequent and positive contact with both parents. While this seems like an obvious conclusion, it was not always this way.

Very often, the lingering bias towards the rights of the mother has more sway over the opinion of the people who matter most-court personnel.

Fathers face unique challenges when they assert their parental rights in court. Although there is often times a mother-leaning bias in the courts, proper arguments that rely on New Mexico law can prevail over any bias that exists.

New Mexico statute is explicit:

The gender of a parent shall have no bearing on decisions regarding child custody or visitation.

At Interlinked, we know from experience that mothers are not necessarily better caregivers than fathers. However, we also know that very often for fathers, it requires the expertise of an attorney who understands and believes that fathers are just as capable as mothers, knows the rules the courts must follow, and how to successfully argue for those cherished rights.

New Mexico is one of only seven (7) community property states in the U.S. Any income, property, or debt acquired during the marriage will be split evenly between the spouses, with a few exceptions.

Dividing the marital property in a New Mexico divorce can be a confusing and daunting affair. The property you owned prior to the marriage, inheritance, and gifts are some examples of the exceptions which will remain sole and separate property. Sounds easy, right?

Dividing the property acquired during the marriage can be fraught with anxiety, and the emotional heartache of a divorce often clouds the reasoning of both parties.

This is very detrimental to negotiating effectively where large items are concerned, such as your home, vehicles, and retirement accounts.

You will need a skilled negotiator on your side who knows the rules and how to use them to your advantage!

New Mexico child support laws require that the income of both spouses be considered when determining child support awards. Once a child support award has been entered, the payments required will continue until the child reaches the age of 19, or completes high school, whichever occurs first. However, additional support as it relates to the child’s education can be agreed upon by both spouses and the signed off on by the court. The court also has the discretion to require one or both of the parents to pay for a child’s health insurance as well as additional medical expenses that insurance cannot cover.

It is a common misconception that mothers are favored over fathers in custody cases.

However, New Mexico law is clear that the courts may not use a gender bias when evaluating which parent should have custody.

To have standing, fathers must first establish their paternity in court before they can exercise those rights.

Once paternity is established, fathers can petition for their rights such as:

- Legal custody
- Physical custody
- Visitation
- Involvement in important life decisions
- Paternal grandparent visitation
- Responsibility for the child's emotional and financial needs
