🚨 Heads up to anyone with a pending green card case 🚨
According to an attorney, USCIS has started sending out RFEs in Adjustment of Status cases asking applicants to prove why they deserve to get their green card approved, not just that they qualify on paper. She stated it was uploaded to her clients portal after their interview yesterday May 22, 2026. Several other attorneys have posted this same RFE. I’m a bit skeptical about it but…the listed information requested is the exact type of information USCIS would possibly ask someone for to prove they warrant a favorable exercise of discretion. Wasn’t my client so can’t give more details on it.
This seems to follow the new USCIS policy issued May 21, 2026, telling officers to treat adjusting status inside the U.S. as a privilege, not a right, and to look harder at every case.
They’re asking for things like:
• family ties here in the U.S.
• hardship to your family if you’re denied
• work history
• tax returns
• community involvement
• English ability
• property or business you own
• proof of rehabilitation if there’s a criminal record
If you’re in this process, start getting your documents together now. Pulling tax returns, getting an employer letters, gathering bank statements, all of that takes time. Don’t wait until an RFE lands with a deadline. Truth be told right now most people should just include this info with their applications preemptively. Probably just upload the docs to your case make the officers job a bit easier.
Getting one of these does not mean you’re getting denied, and not everyone is going to get them. But USCIS is clearly looking harder at these cases, so be ready.
If you get an RFE, don’t panic and don’t ignore it. Read it carefully and get help if you’re not sure what they’re asking for.
