With deep sorrow, we are saddened by the passing of His Lordship Hon. Justice Kenneth Kakuru at Agha Khan Hospital Nairobi. Sources close to the late reveals that His Lordship succumbed to Cancer. The fallen, has been a strong activist of safe ecology and environment.

At the time of his death, he was a Justice of Court of Appeal.

May His soul rest in eternal peace.

Highlights on orders made by the Constitutional Court that affects administration of Sentences.

Case: Sundya Muhamudu & 568 others vs Attorney General, Constitutional Petition No. 024 of 2019

Court Held as follows;
1) Any order by court that imprisonment would be served without earning remission by a prisoner interfers with the doctrine of separation of powers and is without jurisdiction.

2) Imposition of a sentence under the enabling laws of Uganda is the preserve of the Judiciary while enforcement of the sentence is the preserve of the Executive under the laws enabled by Parliament.

3) The Law Revision (Penalties in Criminal Matters) Miscellaneous (Amendment) Act, 2019 doesn't apply to sentences imposed before it came into force.

4) The Judiciary has no jurisdiction to bar the application or enforcement of a provision in an Act of Parliament such as section 86(3) of the Prisons Act 2006 without first checking such a provision unconstitutional or ultra vires.

5) Any order by a court that a sentence of life imprisonment shall be served without earning remission before the coming into force of the Law Revision (Penalties) in Criminal Matters Miscellaneous (Amendment) Act, 2019 is a discriminatory treatment of such convicts in comparison with other prisoners also sentenced to life imprisonment and infringes Art. 21 of the Constitution.

6). Sentences of between 21 to 73 years imposed to petitioners do not have any enabling law prescribing such penalties and as such they contravene Art. 28(8) and (12) of the Constitution.

7) Sentences of between 21 to 73 years of imprisonment imposed to the petitioners will be deemed to be sentences of 20 years imprisonment.
