Romantic Love Relationships at workplaces should be left to grow naturally and cannot be a ground for termination, Kenyan Court rules.

In Mark Ngugi Mwaura v G4S Kenya Limited, Case Number E232 of 2021, the Employment and Labor Relations Court in Nairobi ruled that it is not the role of an employer to regulate personal relationships among consenting adults. The court found that the Claimant’s termination by their Employer in this case was unconstitutional, constituting an infringement of the employee’s right to privacy as protected under Article 31 of the Kenyan Constitution as well as the employee’s right to dignity under Article 28. The Claimant was awarded compensation of Kshs 3,244,800/-, which is equivalent to 12 months salary.

This decision highlights the necessity of balancing workplace policies with employee’s constitutional rights to privacy and dignity. The decision emphasizes that workplace policies that prohibit romantic relationships infringe on the privacy of employees and are not legally defensible.
