Наразі Конвенцію підписали 34 держави, а 3 держави її ратифікували з моменту першої церемонії підписання в Пекіні у 2022 році та другої – на Мальті у 2024 році.

The dispute arose from a breach of contractual obligations under bills of lading, which caused the client to incur substantial costs related to emergency and salvage operations. To protect the Cargo Owner’s interests, a maritime claim was secured in Ukraine.
At the initial stage, the vessel was arrested in Ukraine as an effective legal measure to secure the Cargo Owner’s claim, significantly strengthening the client’s negotiating position.
Following the arrest, the dispute was successfully resolved through strategic negotiations, allowing the parties to settle without further procedural steps. This ensured a prompt and commercially efficient outcome aligned with the client’s interests.

At the initial stage, the vessel was arrested in Ukraine as an effective legal measure to secure the Charterer’s claim. Following the arrest, the dispute was successfully resolved through strategic negotiations, allowing the parties to reach a settlement without fur@ther procedural steps or prolonged arbitration proceedings. This approach ensured a swift and cost-effective outcome fully aligned with the Charterer’s commercial objectives.

The claim arose from the Master’s breach of the rules governing the entry of vessels into Ukrainian ports, which resulted in losses for both the charterer and the consignee. Cases of this nature are becoming increasingly common in Ukrainian jurisdiction, reflecting the ongoing challenges.
The team at BLACK SEA LAW COMPANY conducted a comprehensive legal analysis of the charterparty and the related breach, following which vessel arrest proceedings were initiated. With extensive experience in shipping disputes, the team ensured swift and effective protection of the Charterer’s interests.

Black Sea Law Company successfully represented the Charterer in a vessel arrest case arising out of the Owners’ failure to tender the vessel under a voyage charter
The Black Sea Law Company team carried out a comprehensive legal analysis of the charter party and the circumstances surrounding the vessel’s failure to present for the agreed voyage. Based on this analysis, the team initiated vessel arrest proceedings within Ukrainian jurisdiction.
Leveraging extensive experience in maritime and charter party disputes, the team ensured prompt and effective protection of the client’s interests, securing legal enforcement of the client’s contractual rights and claims.

🇺🇦 Black Sea Law Company домоглася визнання арбітражного рішення LMAA українським судом відповідно до Нью-Йоркської конвенції 1958 року.
Лондонська асоціація морських арбітрів (LMAA) задовольнила позов іноземного Судновласника проти Фрахтувальника за порушення договору фрахтування (Charter Party). Арбітражне рішення було визнано та оголошено таким, що підлягає виконанню на території України відповідно до Нью-Йоркської конвенції 1958 року.
Усі заперечення Фрахтувальників були відхилені українським судом, який ухвалив рішення на користь нашого Клієнта щодо всіх сум, присуджених арбітражним рішенням, включно з нарахованими відсотками.
🇬🇧 Black Sea Law Company achieved recognition of an LMAA Arbitral Award by a Ukrainian court under the 1958 New York Convention.
The London Maritime Arbitrators Association (LMAA) upheld the claim of a foreign Shipowner against the Charterer for breach of the Charter Party. The arbitral award has now been recognised and declared enforceable in Ukraine under the 1958 New York Convention.
All objections raised by the Charterers were dismissed by the Ukrainian court, which ruled in favour of our Client with respect to all amounts awarded under the Arbitral Award, including accrued interest.
