Russia’s sovereign rights and immunities are not absolute. Ukrainian nationals and any person or company suffering losses from Russia’s military aggression against Ukraine should have the right to sue Russia in Ukrainian courts. To ensure effective enforcement, Ukrainian courts shall deny Russia’s immunities, sending them in the direction of Russia’s warship. Still, courts shall also be able to consider collective claims against Russia, to issue worldwide discovery orders and worldwide freezing orders, and shall have other modern instruments to make Russia and its nationals pay for Russia’s unprovoked military aggression against Ukraine.

Oleh Marchenko, a Disputes Partner at Ulysses, explains for Європейська правда how Ukraine and its courts shall treat Russia’s sovereign immunities and what changes to Ukrainian procedural rules could be enacted for Ukrainian courts to have powerful weapons to force Russia to pay for the war. Besides, Ukraine and the Allies States may invoke individual and collective rights to self-defense to freeze and conduct a forced sale of any properties of Russia and its nationals to enforce the orders and decisions of Ukrainian courts for damages caused by Russia’s war.

The worst moments in our lives challenge us to think of each other and our future. They make us remember where we started and where we are going. Twelve years back, we started in Ukraine as ULYSSES Law Firm. With this name, we now want to move ahead.

As for the rest, we do not betray ourselves and remain who we are — a law firm originating in Ukraine and specializing in Transactions and Disputes with a focus on international law, investor-state disputes, and complex litigation. We help clients to win disputes and close deals. But after Russia invaded Ukraine, our primary goal on the legal front line is to make Russia pay for its war crimes and to contribute to reconstructing Ukraine after we win the war.

Our lawyers contribute to justice, making Russia pay for its war in Ukraine and reconstructing Ukraine.

💙💛 “The general situation for the legal market is very bad. In most cases, PEOPLE ARE CONCENTRATING NOW ON OTHER THINGS. Perhaps if the military situation in Ukraine was safer, and Ukraine was prevailing, if I had more transaction work to do, I might consider going back to work – to keep up the economy and pay taxes. But for now, there is no transaction work...”

FORWARDER Magazine talks to our Transactions Partner Roman Shulyar, who has swapped his business suit for combat fatigues and a Kalashnikov in defense of our country following its invasion by Russian military forces.
