Privy Council to sit on Ferguson case Monday and these are the issues:

1) Is the Administration of Justice (Inductance Proceedings) (Amendment ) Act (No 15 of 2012) hereinafter called (the Amendment Act) unconstitutional because it breaches either the separation of powers or the rule of law?

2) Did the Amendment Act prima face infringe the appellants right to due process under s4 (a) and 5 of the Constitution of the Republic of Trinidad & Tobago.

3) If answer to issue 2 Is yes was the amendment act nonetheless reasonably justifiable in a society that has a proper respect for the rights and freedoms of the individual, so as to be immune from challenge under s13 of the Constitution?

4) Who has the burden of proof in relation to this issue?

If the amendment act was not unconstitutional and no challenge is possible under s4 and s5 of the Constitution, would the continued prosecution of appellants nonetheless constitute an abuse of process at common law
