Registration for Equal Marriage

23 Jan. 2025 is the day when the marriage law became equal?
The Act amending the Civil and Commercial Code (No. 24) B.E. 2024 has officially come into effect. It gives people of any gender the right to register for marriage equally under the law.

The Grounds of action for divorce are as follows:
1. If the husband or the wife who is maintaining or lauding other person as his or her spouse or having got an adulterer, or has had sexual in*******se in a regularity, the other party can enter a claim for divorce.
2. The Husband or wife has had the immorality, whether such immorality is the criminal offence or not, If it causes the other spouse:
(a) Being seriously ashamed:
(b) Being insulted of hated on the ground that the continuance of being husband or wife of spouses having committed the immorality: or
(c) To sustain excessive injury or trouble when the condition, the position and cohabitation as husband and wife being take into consideration The other spouse is able to enter a claim for divorce.
(3) The husband or wife has committed bodily harm or tortured to the body or the mind of the other spouse, or has contemplated or disgraced the other or the ascendants of the other ,but all these, If it is the terrible, the other spouse is able to enter a claim for divorce ;
(4)The husband or wife has deserted willfully the other spouse for more time than one year,
4.1 The husband or the wife has been adjudged by the final imprisonment and the husband or wife has been imprisoned for more time than one year in the offence being committed without any participation, consent or knowledge of the other side, and the cohabitation as husband and wife can cause the other side sustain the excessive injury or the trouble, the one spouse can enter a claim or the divorce,
4.2 The husband or the wife volunteer to live separately because of being unable to cohabit as the marital peacefully for more time than three years, or has live separately more time than three years by the order of court, either husband or wife can enter a claim for divorce;
(5)Either husband or wife has been adjudged as the disappeared person, or has left own domicile or own residence for more time than three years and being uncertain whether husband or wife is living or has died, the other side can enter a claim for divorce:
(6)The husband or wife has not given the proper maintenance and the support to the other side, or has committed acts the be seriously adverse to the relationship of the husband and the wife, but all these, if that acts are beyond the scope of the other side having been in the excessive trouble which the condition, the position and the cohabitation as husband and wife are taken into the consideration, the other side is able to enter a claim for divorce;
(7) The husband or the wife has been an insane person for more time than three years continuously and the insanity to be hardly curable so that the continuance of the marriage is not able to expect, the other side can enter a claim for the divorce;
(8)The husband or the wife having broken the bond of good behavior being executed by either husband or wife, the other side can enter a claim for divorce.
(9) The husband or the wife suffer from communicable and dangerous disease which is able to cause the damage to the other side, and it is in the nature of chronic disease which can be incurable, the other side can enter a claim for divorce
(10)The husband or the wife has a physical disadvantage, so as to be permanently unable have sexual in*******se as husband and wife, the other side can enter claim for the divorce.

12 กลโกงธุรกิจอสังหาริมทรัพย์ที่เกิดขึ้นบ่อย!!
1.ผู้ถือกรรมสิทธิ์ในที่ดินนำโฉนดของตนไปประกันเงินกู้โดยไม่ได้จดทะเบียน แล้วไปขอรับใบแทนโฉนดที่ดินมาถือไว้ โดยอ้างโฉนดที่ดินสูญหาย เมื่อได้รับใบแทนแล้วก็นำไปจดทะเบียนขาย ขายฝาก หรือจำนองผู้อื่นต่อไป
เมื่อเกิดปัญหา ก็จะทำให้เดือดร้อนทั้งสองฝ่ายคือฝ่ายถือโฉนดประกันเงินกู้หรือเจ้าของเงินต้องฟ้องต่อศาลเพื่อให้เพิกถอนใบแทนเพื่อให้โฉนดเดิมมีผล ส่วนผู้รับจำนองใบแทนก็ต้องฟ้องไล่เบี้ยเอากับเจ้าของที่ดินอีกทอดหนึ่ง
2.ผู้ถือกรรมสิทธิ์ที่ดินทำสัญญาซื้อขายที่ดินรับเงินไปแล้วบางส่วนหรือทั้งหมด แต่ให้ผู้อื่นครอบครองที่ดินก่อนแล้วโอนที่ดินให้ภายหลัง แต่ต่อมาผู้ถือกรรมสิทธิ์นำโฉนดไปจดทะเบียนให้ผู้อื่น หรือเป็นการนำที่ดินนั้นไปขายต่อ
3.กรณีผู้ถือกรรมสิทธิ์หลอกลวงผู้ซื้อ โดยการชี้ที่ดินที่เสนอขายให้ผิดกับความเป็นจริง เช่น จำนวนที่ดินไม่ครบตามระบุไว้ในเอกสาร
4.ผู้ถือกรรมสิทธิ์แบ่งขายที่ดินเป็นแปลงๆ ด้วยวิธีผ่อนชำระแต่เมื่อถึงขั้นตอนการโอนปรากฏว่าที่ดินโอนเป็นชื่อผู้อื่นไปแล้ว
5.ผู้ทุจริตเป็นเจ้าของโครงการหมู่บ้านจัดสรร เมื่อจัดทำโครงการและขายที่ดินหรือสิ่งปลูกสร้างไปแล้วไม่ยอมทำตามที่ประกาศและโฆษณาไว้ เช่น จัดทำสนามเด็กเล่น หรือสวนสาธารณะของหมู่บ้าน
6.ผู้ทุจริตอ้างตัวเป็นเจ้าของโครงการ โดยแอบอ้างเอาที่ดินของคนอื่นมาปักป้ายประกาศสร้างโครงการบ้านจัดสรร เปิดสำนักงานชั่วคราว โดยให้ผู้จองมัดจำหรือจ่ายเงินดาวน์ แต่ไม่มีการก่อสร้าง
7.ปัญหาผู้ทุจริตหลวกลวงหรือลักเอาโฉนดที่ดินของผู้อื่นมา แล้วทำใบมอบอำนาจปลอมนำที่ดินไปบอกขายหรือรับเงินมัดจำ ทำให้เกิดความเสียหายทั้งผู้ซื้อและผู้ขาย
8.ผู้ทุจริตหลอกลวงหรือลักเอาโฉนดของผู้อื่นมาแก้ไขชื่อผู้ถือกรรมสิทธิ์ให้เป็นชื่อของตน แล้วนำไปประกันเงินกู้หรือทำสัญญาซื้อขายกับผู้อื่น
9.ผู้ทุจริตหลอกลวงเอาโฉนดพร้อมใบมอบอำนาจ ซึ่งผู้ถือกรรมสิทธิ์ได้ลงชื่อไว้โดยมิได้กรอกข้อความใดๆ โดยตั้งใจมอบอำนาจให้จำนองหรือขอสอบเขตที่ดิน แต่ผู้รับมอบอำนาจทุจริตนำมากรอกข้อความให้เป็นการจดทะเบียนขายฝาก
10.ผู้ทุจริตหลอกลวงเอาโฉนดที่ดินของผู้อื่นมาปลอมตัวว่าเป็นผู้ถือกรรมสิทธิ์ที่ดินขอจดทะเบียนขาย โดยปลอมลายเซ็นและปลอมบัตรประจำตัวประชาชน และเมื่อมาขอจดทะเบียนขาย เจ้าพนักงานที่ดินเรียกขอดูบัตรปรากฏว่าชื่อเป็นเจ้าของที่ดินจริง จึงยอมจดทะเบียนให้ไป เป็นปัญหาที่เกิดขึ้นมากในหมู่คนใกล้ชิด
11.ผู้ทุจริตกระทำตนเป็นนายหน้าวิ่งเต้นขายที่ดินให้แก่เจ้าของที่ดิน โดยขอค่านายหน้าแล้วหลอกให้เจ้าของที่ดินเซ็นสัญญามัดจำผูกมัดให้โอนที่ดินให้ก่อน โดยชำระเงินบางส่วน จากนั้นสมคบกับผู้ซื้อ ผู้รับจำนอง หรือผู้รับซื้อฝากจดทะเบียนที่ดินนั้นโดยไม่ชำระส่วนที่เหลือ
12.ผู้ซื้อไม่ยอมชำระราคาให้ครบถ้วน เมื่อได้รับการโอนกรรมสิทธิ์เรียบร้อยแล้ว

Where a person dies with out having made a will or if having made a will, his will has no effect, the whole of his estate shall be distributed among his statutory heirs according to law.
Where a person dies having made a will wich disposes of or has effect for a part only of his estate, the part which has not been disposed of or is not affected by the will shall be distributed among his heirs according to law.

⚖️ การบังคับใช้กฎหมายอาญาเพื่อลงโทษบุคคลผู้กระทำความผิด เป็นเรื่องที่กระทบต่อสิทธิและเสรีภาพส่วนบุคคลของประชาชนโดยตรง ดังนั้นจึงต้องมีการบัญญัติกฎหมายให้ชัดแจ้ง ตามหลักประกันในกฎหมายอาญาที่เรียกในภาษาละตินว่า “Nullum crimen nulla poena sine lege” แปลว่า “ไม่มีความผิด ไม่มีโทษ หากไม่มีกฎหมาย”
📝 หลักการนี้ถูกนำมาบัญญัติไว้ในประมวลกฎหมายอาญามาตรา 2 และรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ.2560 มาตรา 29 วรรคหนึ่ง ซึ่งบัญญัติว่า “บุคคลไม่ต้องรับโทษอาญา เว้นแต่ได้กระทำการอันกฎหมายที่ใช้อยู่ในเวลาที่กระทำนั้นบัญญัติเป็นความผิดและกำหนดโทษไว้ และโทษที่จะลงแก่บุคคลนั้นจะหนักกว่าโทษที่บัญญัติไว้ในกฎหมายที่ใช้อยู่ในเวลาที่กระทำความผิดมิได้”
📚 นอกจากนี้มาตรา 29 วรรคสองยังได้บัญญัติหลักสันนิษฐานความเป็นผู้บริสุทธิ์ของผู้ต้องหาหรือผู้ถูกฟ้องคดี (Presumption of Innocence) ใจความว่า "ในคดีอาญาให้สันนิษฐานไว้ก่อนว่าผู้ต้องหาหรือจําเลยไม่มีความผิด และก่อนมีคําพิพากษาอันถึงที่สุดแสดงว่าบุคคลใดได้กระทําความผิด จะปฏิบัติต่อบุคคลนั้นเสมือนเป็นผู้กระทําความผิดมิได้” กรณีนี้เป็นหลักประกันช่วยคุ้มครองสิทธิขั้นพื้นฐานของประชาชน ไม่ให้ถูกจับกุมดำเนินคดี หรือตัดสินลงโทษโดยไม่เป็นธรรม
✅ หากประชาชนคนใดถูกแจ้งข้อกล่าวหาโดยเจ้าพนักงานตำรวจ หรือถูกฟ้องคดีต่อศาล กฎหมายจะรับประกันสิทธิขั้นพื้นฐานให้ว่าผู้ต้องหาหรือผู้ที่ถูกฟ้องเป็นผู้บริสุทธิ์ จนกว่าโจทก์จะพิสูจน์ให้ศาลปราศจากความสงสัยว่าบุคคลนั้นได้กระทำความผิดตามที่ฟ้องจริง (beyond reasonable doubt)
