We ensure these leases are properly formulated and registered with the Land Department to be legally enforceable against third parties.
o Superficies Rights: Governed by Sections 1410-1416 of the Civil and Commercial Code, a superficies allows an individual to own structures or plantations situated on another person's land. This legal concept facilitates separate ownership of the building from the land, offering a robust form of protection for foreign real estate investors.
o Sap Ing Sith: This newer property right, introduced by the Sap-Ing-Sith Act B.E. 2562 (2019), grants the holder the right to use and benefit from immovable property, including land with a Chanote, buildings on such land, and condominium units. It can be registered for up to 30 years with the possibility of renewal, and importantly, can be transferred and used as security for a mortgage, offering enhanced control and financial security compared to traditional leases.
o Partnership Memoranda: We can also prepare Memoranda of Understanding (MOUs) between partners or family members to clarify beneficial ownership and financial contributions, adding a layer of transparency and security.
o Loan and Mortgage Agreements (where no existing bank mortgages are outstanding): In situations where there are no existing bank mortgages on the property, we can assist in drafting and registering private loan and mortgage agreements to secure your investment. This ensures that the terms of the loan, the mortgaged property, and the maximum secured amount are clearly defined and registered in accordance with Sections 702-714 of the Civil and Commercial Code, providing a legally enforceable claim against the property.
