Here is a quick summary of the four main types of deeds you need to know:
• 🔴 Chanot (Nor Sor 4): The "Gold Standard" featuring a Red Garuda. This grants true ownership, full rights, and features highly accurate GPS-plotted boundaries.
• 🟢 Nor Sor 3 Gor: Featuring a Green Garuda. This provides good legal security and a confirmed right of possession, allowing you to build and mortgage safely.
• ⚫ Nor Sor 3: Featuring a Black Garuda. This is an unconfirmed right of possession with vague boundaries and carries a high level of risk.
• 📄 Por Bor Tor 5 / Sor Kor 1: No Garuda, no color. This is essentially just an agricultural tax receipt for government land. You absolutely cannot legally buy, sell, or mortgage this land, and the government can reclaim it (and tear down any structures) at any time. Stay away!.

Here is the tough love reality check on what they CANNOT do:
❌ They are not a bank: They will not give you cash for a hotel or pay your medical bills. Emergency loans exist as a last resort, but they are a nightmare to get and the embassy will keep your passport until the government debt is paid back in full.
❌ They cannot get you out of jail: They are civil servants, not lawyers. They will not interfere with the Thai judicial system—even the King of England cannot overrule a Thai judge who says "no bail".

Here is what they CAN do:
✅ Act as welfare observers & family liaisons: They make sure you aren't being singled out as a foreigner. They will also help you contact your family back home so your loved ones can send funds via services like Western Union.

WARNING EXPATS: Why Your Foreign Will is a NIGHTMARE in Thailand!

Do you need a Thai Will if you already have one from your home country?

We frequently get asked by expats if a Last Will from the UK, America, or elsewhere can cover their assets in Thailand. Technically, yes it can, but relying on a foreign Will here is often an absolute procedural nightmare for your grieving loved ones!
In our latest video, John from Anglo Siam Legal explains why having a separate Thai Will is crucial for anyone living or holding assets in the Kingdom.

Why You Need a Dedicated Thai Will:
• The Foreign Will Nightmare: Using a foreign Will in Thailand means you must first go through the probate process in your home country, which can take 6 to 18 months. Then, the court orders must be translated, certified, and stamped by both your home embassy and the Thai Ministry of Foreign Affairs. It is a lengthy, expensive, and administratively burdensome process during an incredibly difficult time.
• The Danger for Unmarried Partners: Thai intestacy rules are incredibly strict and follow a specific line of succession (parents, children, siblings). Thai law does not recognize cohabiting partners, civil ceremonies, or Buddhist weddings. Without a Will, your partner will get absolutely nothing.
• Frozen Assets: If you die without a Will (intestate) in Thailand, your bank accounts and cars can be frozen, leaving dependent loved ones without access to vital funds and causing significant hardship.
• The Solution: Having a separate Thai Will to cover your local assets (condos, bank accounts, cars) clarifies your wishes and significantly speeds up the court and probate process in Thailand.

The Best Strategy: Keep it clean, tidy, and organized. If you have assets in multiple countries, have a Last Will in each jurisdiction where those assets are held.

Understanding Thai Visa Overstay Penalties: Don't Get Caught Off Guard!

Are you an expat, tourist, or business traveler in Thailand? It is crucial to know your visa rules and exactly how long you are permitted to stay. We routinely get asked about Thai immigration laws, so our Client Affairs Manager, John, has put together a new laid-back video explaining exactly what happens if you overstay.

The golden rule of Thai immigration penalties is simple: while the cash fine remains the same, the length of your future ban depends on how long you overstayed and whether you surrender voluntarily or get caught.

Here are the key takeaways from the video:
• The Fine: The standard overstay fine is 500 THB per day, which caps at a maximum of 20,000 THB.
• Under 90 Days (Surrendered): If you have a short overstay and surrender at the airport departure gate, you simply pay the fine, get an overstay stamp, and avoid a reentry ban.
• Under 90 Days (Arrested): If police catch you outside the airport with an overstay, you face an immediate 5-year blacklist ban, processing at the Immigration Detention Centre (IDC), and deportation.
• Over 90 Days: This is a major violation. If you surrender, bans range from 1 year to 10 years depending on the exact duration of the overstay. If you are arrested, a 91-day to 1-year overstay jumps to a 5-year ban, while anything over 1 year results in a 10-year ban, plus jail time at the IDC and deportation.
• Minors: Children under 18 years old are not subject to overstay fines or deportation, but they will still receive a standard overstay stamp in their passport.

The Bottom Line: If you overstay, even by a single day, go to the airport, surrender, and handle the matter properly. You never know when you might be stopped at a checkpoint or while walking down the street, and the ramifications of getting caught are severe.

Here is what you are risking if you get involved in a brawl:
• Criminal Penalties: Causing bodily harm (Section 295) carries penalties of up to two years in prison, a 40,000 baht fine, or both. Furthermore, if you are involved in a group brawl (Section 299), you can face up to a year in prison even if you did not throw a single punch.
• Crippling Civil Lawsuits: Under Section 420, victims can sue you for private hospital medical bills, lost salary, and compensation for pain and suffering.
• The Immigration "Death Sentence": Being charged with a violent crime can lead to your passport being held by the court so you cannot leave the country or work. Ultimately, you risk deportation and being blacklisted from Thailand for 5 to 10 years, or even for life.
• Narrow Self-Defense Laws: Under Section 68, claiming self-defense requires proving the threat was imminent and your response was reasonable.

While it is easy to fall into a daily routine, things that might be considered minor offenses back home are taken very seriously here. Watch the video to learn about these three critical areas:
• The Driving License Trap: A foreign license or International Driving Permit (IDP) is only valid for your first 90 days in Thailand. If you are on an extended visa over 90 days, you must obtain a Thai driving license. Driving without the correct license will void your insurance coverage. This leaves you personally responsible for damages, which can lead to criminal litigation, jail time, deportation, and blacklisting.
• Immigration Administrative Reporting: Thai immigration authorities are enforcing administrative regulations more rigorously than ever. You must complete your 90-day reports either at immigration or via the digital portal. Furthermore, if you own property, you are responsible for submitting your own TM30 within 24 hours of entering the country. Failure to comply can result in penalties and create problems for your next visa renewal.
• Social Media & Defamation: Posting derogatory comments online that cause a person to lose face, feel shame, or experience hardship is a criminal offense in Thailand. Defamation charges can result in criminal proceedings, being placed on bail for up to 84 days, visa revocation, deportation, and blacklisting. If you have a dispute, do not bite or criticize online; handle it privately or seek professional mediation.

• Border & Airport Scrutiny: Over 150,000 people have been denied entry into the kingdom this year alone. • Be Prepared: When entering Thailand, you must be prepared for increased scrutiny. Ensure you have cash dependent on your visa, a travel itinerary, and proof of onward or return flights.
