แม้จะเป็น "เจ้าหนี้ผู้รับจำนอง" ที่มีสิทธิได้รับชำระหนี้ก่อน แต่ก็ไม่ควรละเลยการไปศาลตามหมายนัด
เมื่อวันที่ 29 มิถุนายน 2569 ทีมทนายความ TNS Legal Works ได้เข้าร่วม นัดไต่สวนคำร้องขอเฉลี่ยทรัพย์ ณ ศาลจังหวัดนนทบุรี ในฐานะผู้รับมอบอำนาจของ เจ้าหนี้ผู้รับจำนอง รวม 2 คดี
คดีประเภทนี้ ลูกความไม่ได้เป็นคู่ความโดยตรงในคดีบังคับคดี แต่เป็น ผู้รับจำนอง ที่มีสิทธิในทรัพย์สินซึ่งถูกบังคับคดี เมื่อมีเจ้าหนี้รายอื่นยื่นคำร้องขอเฉลี่ยทรัพย์ ศาลจึงมีหมายนัดให้ผู้มีส่วนได้เสียเข้าร่วมการไต่สวน เพื่อพิจารณาสิทธิของแต่ละฝ่ายให้ถูกต้องตามกฎหมาย
หลายคนอาจคิดว่า เมื่อเป็นผู้รับจำนองซึ่งมีบุริมสิทธิเหนือเจ้าหนี้ทั่วไป ก็ไม่จำเป็นต้องไปศาล แต่ในทางปฏิบัติ การเข้าร่วมการพิจารณาตามหมายนัด ย่อมช่วยให้สามารถตรวจสอบข้อเท็จจริง ชี้แจงสิทธิ และป้องกันปัญหาที่อาจเกิดขึ้นในภายหลังได้
การมีทนายความหรือผู้รับมอบอำนาจเข้าดำเนินการแทน จึงช่วยให้ลูกความมั่นใจว่าขั้นตอนต่าง ๆ เป็นไปอย่างถูกต้อง และสิทธิของตนได้รับการคุ้มครองอย่างเหมาะสม

Even though a mortgagee has priority in receiving payment, a court summons should not be ignored.
On 29 June 2026, the legal team of TNS Legal Works attended hearings on applications for the distribution of proceeds from enforced property sales at the Nonthaburi Provincial Court, acting as the authorized representatives of mortgagee creditors in two cases.
In cases of this nature, our clients are not direct parties to the enforcement proceedings. Rather, they are mortgagees who hold legal rights over the properties subject to enforcement. When other creditors file applications seeking a share of the proceeds, the Court issues summonses requiring interested parties to attend the hearing so that the rights of each party can be properly considered in accordance with the law.
Some people may believe that, because a mortgagee has priority over ordinary creditors, there is no need to attend the Court hearing. In practice, however, attending the hearing allows the mortgagee to review the relevant facts, clarify its legal rights, and help prevent potential problems from arising later.
Having a lawyer or an authorized representative attend the hearing on the client’s behalf provides reassurance that all procedures are properly handled and that the client’s rights are appropriately protected.
