ส่วนใหญ่บริษัทเอกชนจะมีสัญญาจ้างงานเราตอนที่เราเข้าทำงานและจะมีเนื้อหาในสัญญาข้อหลักๆเช่น ต้องมีผู้ค้ำประกัน เป็นสัญญาจ้างทดลองงาน มีกำหนดระยะเวลาสัญญาจ้าง เป็นเวลา 119 วัน

ทุกท่านทราบหรือไม่ว่า สัญญาบางข้อที่ทางบริษัททำขึ้นแล้วให้เราเซ็นเป็นสัญญาที่ขัดต่อกฎหมาย ตกเป็นโมฆะ แต่เราก็ไม่อาจที่จะหลีกเลี่ยงไม่เซ็นได้ เพราะเราอยู่ในฐานะการต่อรองที่ด้อยกว่า แต่หากแม้มีการยกเลิกสัญญาจ้างด้วยเหตุที่ไม่เป็นธรรม หรือกรณีใดก็แล้วแต่ หากนายจ้างจะยกเอาสัญญาข้อที่ฝ่าฝืนต่อกฎหมายมาบังคับใช้กับเรานั้นโดยทางปฏิบัติ หากเราไม่ยอมและมีการเรียกร้องหรือฟ้องร้องขึ้นศาล นายจ้างก็ไม่อาจบังคับตามสัญญาข้อนั้นได้

เหตุใดจึงมีข้อสัญญาจ้างเป็นระยะเวลา 119 วัน ???????????

เพราะตามกฎหมายแรงงาน หากลูกจ้างทำงานให้กับนายจ้างครบระยะเวลา 120 วัน แล้วนั้น ถ้านายจ้างบอกเลิกสัญญาจ้างโดยไม่มีเหตุอันชอบด้วยกฎหมาย นายจ้างจำต้องจ่ายค่าชดเชยให้แก่ลูกจ้างนั่นเอง จึงเป็นที่มาของข้อสัญญา 119 วัน

และหากลูกจ้างทำงานเกิน 1 ปี, 3ปี, 6ปี และ 10 ปี ขึ้นไป นายจ้างต้องจ่ายค่าชดเชยมากขึ้นตามลำดับ

แต่ทั้งนี้ กฎหมายแรงงานไม่ใช้บังคับกับข้าราชการ
