The High Court has established a stricter sentencing framework for "silent" company directors - that is, individuals who assume directorship only in name while neglecting their duties as officers of the company. This arose out of a case where such a director was convicted for allowing his company to be used for illicit financial activities.

The revised sentencing framework underscores the gravity of such misconduct, and aims to deter the considerable harm potentially arising therefrom.

A clinic assistant was sentenced to 14 months’ jail for cheating over 509 patients of more than S$55,000 by replacing the clinic’s official PayNow QR code with that of her own bank account, as well as providing patients with her own PayNow number for payment of medical bills. She had also changed her PayNow display name to that of the clinic's doctor to avoid suspicion.

The High Court acquitted a 60-year-old woman of charges against her for abusing her domestic helpers and overturned her earlier conviction after identifying significant inconsistencies in the domestic helpers' testimonies.

Notably, the judge found several inconsistencies in relation to key aspects of the factual assertions underlying the charges against her. These inconsistencies were deemed to have undermined the prosecution's case, and rendered the evidence insufficient to prove the prosecution's case beyond reasonable doubt.

A Singaporean woman was sentenced to 14 months' imprisonment for her involvement as a money mule in a U.S. phishing scam. Close to S$4.8 million had passed through bank accounts in her name, including that of a company in which she had provided her SingPass credentials for herself to be registered as the locally resident director. The funds, suspected to be proceeds from the scam, were transferred into these accounts in multiple tranches before quickly being dissipated to various other accounts.

The accused pleaded guilty to three charges: possessing suspected criminal benefits, providing unauthorized access to a bank account, and failing to diligently discharge her duties as a company director.

A man involved in a transnational crime syndicate ("Lim") was sentenced to 3 years and 9 months' imprisonment after pleading guilty to three counts of handling the benefits of criminal conduct amounting to $125,000. Four other charges were also considered during sentencing.

Lim was first introduced to the China-based group known as "OpenPay" sometime in 2023, having been offered a job which involved collecting money in Singapore and converting the same into cryptocurrency. Lim would then remit 99% of these sums to OpenPay's cryptocurrency wallet and retain the remaining 1% as his commission for the transaction.

In total, Lim assisted in cheating two Singaporean victims of a sum totalling S$501,151, for which he received around RM10,000 (S$3,000) as commission.

During the trial, Lim's lawyers emphasised his cooperation with the authorities, and how this had been instrumental in resolving the case.

Chief Justice Sundaresh Menon has reported a significant trend toward the use of the simplified track in divorce proceedings in Singapore. It was shared during the recent Asian Family Conference that two-thirds of divorce cases in 2023 were uncontested, with parties opting for the simplified track where parties mutually agree on all aspects of the divorce and ancillary issues such as children's issues and maintenance.

Two siblings successfully obtained personal protection orders ("PPO") against each other.

The brother had applied for a PPO and partial domestic exclusion order against his sister on the basis of her repeatedly entering his bedroom late in the night to clean it. He found this to be invasive and distressing, to the extent that it had even led to him being admitted to the Institute of Mental Health on multiple occasions.

On the other hand, the sister's application stemmed from an altercation between the siblings, triggered by the same issue, during which she was assaulted by the brother.

The judge granted both applications, satisfied that the respective courses of conduct of each sibling sufficed to constitute acts of family violence, and that a PPO was necessary in the particular circumstances of this case.

Two individuals implicated in a corruption case involving the purported bribery of a former Land Transport Authority director were acquitted of their charges.

A key point leading to their acquittal was the trial judge's finding that statements taken by the Corrupt Practices Investigation Bureau (CPIB) were unreliable and inaccurate. The investigation officers were found to have selectively recorded their statements, focusing only on parts that could be interpreted as incriminating whilst omitting potentially exculpatory details.

A 19-year-old student ("Seah") was sentenced to a six year imprisonment term for a charge of culpable homicide, after killing his father with two knives.

Originally charged with murder, the charge was reduced on account of Seah's severe depressive disorders as well as his guilty plea.

In determining the appropriate sentence, the Court had taken into account the years of verbal and physical abuse that Seah had suffered at the hands of his father. The Defence had also raised that Seah feared for his life, believing that his father would kill him if he did not act first.

A man who physically abused his 11 year-old daughter was sentenced to 1 year's imprisonment for one charge of ill-treatment of a child under the Children and Young Persons Act. The mother of the child was also sentenced to an imprisonment term of 10 months for having stood by and failing to take steps to protect the child during the occasions of abuse.

In ascribing these sentences, the judge had also taken into account the fact that the victim was especially vulnerable due to her special needs.

Owing to a misinterpretation of a term of the trust, monies held on trust for descendants of a wealthy trader were erroneously distributed for nearly 20 years. Some beneficiaries were receiving money beyond their entitlement, while others received less than their rightful share.

In an unprecedented ruling by our local courts, the High Court held that a trustee who has made over-payments to a beneficiary has a right and duty to recoup the over-payment, and may do so by adjusting future payments to the overpaid beneficiary. In the circumstances, the court approved of the trustees' proposed plan to recoup and redistribute an estimated S$1.18 million to the underpaid beneficiaries.
