The Man Behind the Bottle: A Toast to the Inventor of the Corkscrew

Did you know we owe our easy summer wine nights to an 18th-century English reverend? 🍷

Meet Samuel Henshall, the Cheshire-born clergyman who patented the first corkscrew in 1795. While earlier versions existed, Henshall’s genius was adding a simple disk—later called the Henshall button—to prevent the spiral from sinking too deep into the cork. This small tweak made his design revolutionary—and patentable!

But back then, patents were a risky bet. Unlike today’s 20-year protections, Henshall’s lasted just 14 years, and the costly process didn’t bring him fortune. In fact, legend says he was buried with his unsold stock—proof that even groundbreaking ideas don’t always pay off.

Yet his legacy lives on. Modern corkscrews, like the "waiter’s friend" (1883), owe their existence to Henshall’s innovation. And today, inventors have it easier: streamlined filings, flexible fees, and expert IP guidance make protecting ideas more accessible than ever.

While Scottish scientist James Dewar invented the vacuum flask in 1892 for his cryogenics research, he never patented it.

Enter Reinhold Burger — a German glassblower who saw its everyday potential. In 1904, he added a protective metal casing, filed a patent, and turned the invention into a household name: Thermos.

It’s a classic example of how patenting an innovation can turn a scientific breakthrough into a global brand.

Every July 17, we celebrate the little icons that have transformed the way we communicate: emojis. From a simple smile 🙂 to a dancing figure 💃, emojis have become a universal visual language crossing cultures and borders. But did you know emojis are also part of the world of intellectual property?

🛡️ Emojis and Intellectual Property – Trademarks & Patents

1️⃣ Trademarks on Emojis

Emojis themselves can function as brands. If an emoji-style icon is used to identify the source of goods or services, it can be protected as a trademark.

For example:
✅ A stylized smiley face used as a company logo.
✅ A unique emoji incorporated into an app icon or product packaging.

To be eligible for trademark protection, the emoji design must be distinctive and used in commerce to indicate origin—not just a generic symbol everyone uses in daily communication.

2️⃣ Copyright Protection

Most emojis are copyrighted artistic works. Emoji sets (like Apple’s, Google’s, or Facebook’s) are created by designers who own rights in their specific renderings. That’s why Apple’s emojis look different from Android’s.

Using or copying these proprietary designs commercially without permission can lead to copyright infringement.

3️⃣ Patents and Emojis

While the emoji designs themselves are not patented, some technologies relating to emoji use can be patented. For example:

🔹 Methods for generating or displaying emojis in messaging apps.

🔹 Predictive emoji suggestion systems.

🔹 Interactive or animated emoji interfaces.

These are typically software patents covering technical functionality behind the scenes, rather than the emojis as artwork.

💡 Tip: If you’re creating a unique emoji set for your brand, consider:

✔️ Trademark registration if you’ll use them as logos or distinctive identifiers.

✔️ Copyright protection for the artwork.

✔️ Design protection (in some countries) for visual appearance.

✔️ Patent protection if you invent a novel technical way of using them.
