Wishing all a very Happy National Day!
In recent weeks we have all been hearing so much about racism, brownface and whatnot. I don't know about you but I myself just switched off. Today I'll share a bit about my reality, my Singapore. Growing up as kids in St. Stephens Primary & St Patrick's Secondary schools we all played together happily - Malay, Chinese, Indian, Punjabi, Eurasian, anyone - all friends. Yes we teased each other openly - Mat, Chinaman, Ah Neh, Gragok/ Chap Cheng, Bhai- but that did not affect our friendships or our mutual respect for each other. Now 45 years on, we are still friends :)
NS was another great experience that I personally believe goes a long way in building the bonds and mindset that overcome divisions ( something our Singapore ladies miss out on, and might actually benefit from) . If your section is digging a foxhole, you don't care if your buddies are yellow black brown , whether they worship Allah Buddha Ganesha Jesus or even if they're bladdy green with feathery antennae growing out of their heads. You judge the guy next to you on whether he has the heart and soul, the spirit , to keep going & to carry his weight, to do his part.

So here we are. There's just 3 million of us Singaporeans, and all we have is this lovely little island we call home. We are family. Lets remember that always.We can always have more empathy for each other as family, look out for each other's best interest, be kinder , a bit less harsh and judgemental and yes, joke and laugh over race and religion without rushing to take offence. Lets be accepting of all in our family - rich & poor, elites & ordinary Singaporeans like me, all skin colours ( including green and grey), religious & free thinkers, all sexual orientations including LGBTQ etc.
Singapore is not perfect. Its our work in progress. But we still have much to be glad for & many blessings.

I know I'm being long winded.

But I am proud to call Singapore my Singapore and to be a Singaporean:)

Had a good day in the State Courts today. This case started in July when an elderly Malay couple came to see me. The aged mother was sobbing as she asked me to hep her son. Son had been arrested in Dec 2017 & was still in jail pending charges.
Son had received a call from his best friend , a Chinese guy. Best friend told son that his girlfriend ( a Thai lady) had been disturbed by a bunch of 8-9 guys at a HDB void deck. When best friend intervened, both he and gf was assaulted. So he called son for help.

Son was worried about confronting 8-9 guys but felt he had no choice but to go help his best bro. Son also feared the group might be armed. So son brought a knife with him to confront the group.

Naturally there was a big fight. Son stabbed one of the group ( an Indian guy) once in the back. Indian guy suffered fractured ribs and deep penetrating traumatic stab wound. Hence son was charged for causing Grievous Hurt with Deady Weapon ( S.326 Penal Code)
Subsequently son faced additional charges for Trafficking & consumption of illegal drugs. .

Deputy Public Prosecutor asked Court to impose cumulative sentence of 12 years &22 strokes of the cane.
Judge noted that the stab was done with great force/ violence a& son had stabbed in cold blood as he was not assaulted by the group.

After much legal arguments, I managed to persuade the Honourabe District Judge to impose a sentence of 10 years and 16 strokes. Jail sentence also backadated to December 2017. With good behaviour, son will be out of jail in less than 7 years.

But I do ask myself, did I do the morally right thing to help the elderly parents and take this case? Is it morally justifiable for the son to get a lighter sentence?

Visited client in Changi Prison today. He's facing 5 charges for various drug offences including 2 trafficking charges. Deputy Public Prosecutor has offered to proceed on 1 trafficking and 1 consumption of drugs charge. We had made representations to DPP to reduce the trafficking charge to possession. If granted will reduce our client's jail time. But won't escape the rotan in any event :(

Just had a call from a worried HDB seller seeking my advice. Buyer & Seller had earlier agreed that Seller could stay on for 8 weeks after Completion. Sellers agent ( experienced guy) made Buyers & Sellers sign a written agreement. However later the Buyers agent came to Sellers home and collected the original agreement on some pretext.

Now Buyer says that she may want the Seller to vacate on Completion an dis refusing to return the Original Agreement.

I told the Seller that it would have been better if she had kept. the Original written agreement. Had she made a copy of the signed agreement? Seller said she took a pic of it. Seller had also saved various whatsapp mesages between Seller & Buyer.

I advised the Seller not to worry so much. Even if the Buyer had destroyed the Original, Pic of agreement shows signatures of parties, witnesses and is dated. Combined with the Whatsapp messages & with the Sellers witness willing to testify in any legal proceedings, there was sufficient proof that parties had made a valid contract to allow Seller an extension of time to vacate the Premises. :)

IMPORTANT NOTE: Always sign Original agreements in a number of sets so that each party keeps one set of the Original Agreement. This makes it much easier if you have a legal dispute and have to go to Court to litigate.

Had a call from a friend with a legal problem over the week end. Parents had give their married son $200K to help purchase a HDB flat with his wife and child. Tragically the son passed away suddenly. Then the wife turns around to say she doesnt know anything about the $200K and will not repay the in laws( the parents). Naturally the parents are shocked & furious but they have did not sign any Loan Agreement or Deed of Trust with the son and his spouse. Now the poor parents have a difficult choice to make - whether to commence a court case to sue the daughter in law to try to recover the $200K :( Sad.
