PROBATE
A Grant of Probate is issued when the deceased has left behind a valid will. A Muslim’s will must comply with the rules of Faraid, Muslim inheritance law.
The executor(s) named in the will must apply for the grant of probate, which is the legal authority to carry out the instructions set forth in the will.
LETTERS OF ADMINISTRATION
If the deceased did not leave a valid will, or the named executor is unable or unwilling to act, an application for the Grant of Letters of Administration must be made.
Number of Administrators
At least 1 and no more than 4 persons can be appointed as administrator(s) in respect of the same estate.
If the beneficiaries include any person(s) below 21 years of age, at least 2 administrators must be appointed.
RE-SEALING OF FOREIGN PROBATE OR LETTERS OF ADMINISTRATION
If a foreign court has granted probate or letters of administration and the deceased has assets in Singapore, there may be no need to apply for a fresh grant of probate or letters of administration in Singapore. Instead, the foreign probate or letters of administration may be submitted to the High Court of Singapore and resealed. Upon resealing, the foreign probate or letters of administration can be used to deal with the deceased’s assets in Singapore.
Typical Duration:
In our experience, the process of obtaining a probate or letters of administration, generally takes between 6 to 12 weeks for straightforward uncontested cases. However, for more complex cases, especially those involving contested wills or multiple beneficiaries, the process will take longer.
Duties of the Administrator or Executor
The appointed administrator or executor is responsible for managing the deceased’s estate. The key duties include:
Locating and securing the assets of the deceased’s assets;
Paying off any outstanding debts or liabilities of the estate; and
Distributing the estate’s assets according to the instructions in the will or the laws of intestacy.
