UM 6237-24

After leave to appeal, and an opinion from JK (which was negative to compensation) and the Bar Association, the Migration Supreme Court today gave me the right to compensation for appealing the decision on body searches. It is thus from now on part of a public counsel's mission.

The firm recently recieved its fifth leave to appeal (UM 6237-24).
The question in the case that has led to the Migration Overcourt granting leave to appeal is to whether an appointment as public counsel for a detained person includes an appeal against a decision on a body search. I strongly believe that should be the case to make the process more secure for the detainees.

For a long time, I have been annoyed by the weak basis of reasonable suspicion that has often been used in decisions about body searches of detainees who have visitors. Now I won just such a case in the Migration Court in Sthlm. It is not enough that the visit is unsupervised and the visitor has "things" with him for reasonable suspicion to exist, according to the court (UM 6700-24).

The firm has recently won several cases where the court released clients from migration-custody on the grounds that the court stated that working illegally is not a serious threat to order and security in our society.

The firm recently won a case in the Migration court in Gothenburg (UM 9652-20), where the court overruled a negative decision from the Migration office, stating that a woman in fact was from Syria and not Armenia. The decision is one of several that the firm has won where previous residence assessments and in some cases language analysis has been found to be ill founded.

Idag erhöll Advokatfirman prövningstillstånd i en dom från Migrationsöverdomstolen UM 1916-20 där Migrationsverkets beslut undanröjs och vår klient togs ur förvar med motiveringen att Migrationsverket inte fattat beslutet enligt kriterierna i 8:3 första stycket mottagandedirektivet.

Migrationsverkets e-tjänst skulle fördela uppdragen rättvist – istället gynnas de jurister som marknadsför sig. En enskild advokat tog på sig 360 asylförordnaden under 2017. Andra jurister, specialiserade på asylrätt, fick nästan inga. Kompetensen spelar ingen roll.
