ILAC released a new report surveying the impact of 12 months of war on Ukraine’s legal system and justice institutions.

Compiled with the assistance of dozens of Ukrainian and international stakeholders, “Surviving the Assault: The Ukrainian Legal System After a Year of War” catalogues information from hundreds of sources and offers insights into the challenges facing the Ukrainian justice sector both during wartime and after the guns go silent.

ILAC released a new report today examining the state of access to justice in Afghanistan under the Taliban regime.

“Justice Matters: A Status Report on Afghanistan Since the Taliban Takeover” provides detailed insight into how courts throughout Afghanistan have gradually resumed functioning over the past 16 months, and the role of Afghan lawyers in advancing individual rights. The report reveals that courts have been operating with irregular procedures and often without the use of any clear legal authorities, and the ability of Afghan women to access the justice system remains severely constrained and in some cases is altogether denied. Still, the report also demonstrates that civil society and Afghan lawyers have been able to achieve results including releases from detention and reduction in punishments.

The report provides a current analysis of how the justice sector vacuum is being filled by the Taliban while underscoring the importance of the international community not giving up on its 20-year investment in justice and legal professionals in Afghanistan. It is based on findings from interviews with 30 lawyers who remain in Afghanistan (across 20 of the country’s 34 provinces) and provides key recommendations for the international community.

HBC lawyers continue to act as opinion leaders around the world, even after retirement. Long time HBC attorney Bill Meyer presented “A System Under Siege: Putin’s War on Ukrainian Justice'' at the fall meeting of Legus International Network of Law Firms last week in Sacramento.

Based on his published report, “Under Assault: A Status Report on the Ukrainian Justice System in Wartime,” the presentation described the damage to the physical and human infrastructure of the country’s legal system, the personal and professional issues facing lawyers in the midst of a shooting war, and the immense challenges facing the Ukrainian legal system in a post-conflict environment.

ILAC's newest publication, "Under Assault: A Status Report on the Ukrainian Justice System in Wartime" documents the toll that five months of war has had on the Ukrainian justice system.

The report surveys region-by-region how the war has practically impacted justice institutions from the judiciary, prosecution, lawyers and law students. The report also surveys, by jurisdiction, the physical damage to courthouses and other infrastructure, and the steps taken by Ukrainian officials to transfer courts and judges out of conflict or Russian-occupied zones.

ILAC intends this status report to be used as a tool – a benchmark – for supporting Ukraine’s justice sector needs now, during wartime, and planning for what will have to be rebuilt once there is peace. By comparing what existed before Russia’s war to what exists now do we begin to realize the magnitude of the war’s impact on Ukraine’s justice system.

ILAC will publish an update to the status report in six months.

Vance Center for International Justicer & International Association of Women Judges, we discussed how judicial associations can strengthen anticorruption efforts and increase judicial independence and diversity.

The Forum brought together experts and practitioners from over 116 countries to learn and advance equal rights, open government, anticorruption and access to justice. Kudos to our member World Justice Project for organising such a necessary forum.

Lanzamos una serie de documentos de discusión sobre América Latina como parte del proyecto Jueces como constructores de paz. Los documentos brindan recomendaciones redactadas por personas que imparten justicia en Colombia, Guatemala y México sobre cómo las y los jueces y las asociaciones judiciales pueden aumentar la seguridad, la independencia, la diversidad judicial y mientras luchan contra la corrupción en América Latina. ILAC presentó los documentos en el Foro Mundial de Justicia de este año en La Haya en colaboración con sus miembros, el Centro Cyrus R. Vance para la Justicia Internacional (Centro Vance) y la Asociación Internacional de Mujeres Jueces (IAWJ).

Como resultado de las sesiones de diálogo y las mesas redondas con los jueces y las juezas locales, estos documentos de debate destacan recomendaciones claves sobre el apoyo a asociaciones judiciales independientes para proteger la independencia judicial, promover la diversidad judicial y combatir la corrupción.

⚖ JUDGES AS PEACEBUILDERS

This series of discussion papers on Latin America is a result of the Judges as Peacebuilders project. It provides recommendations drafted by local partners from Colombia, Guatemala, and Mexico on how judges and judicial associations can increase judicial security, independence, diversity, and counter corruption in Latin America. ILAC launched the papers at this year’s World Justice Forum in The Hague in collaboration with its members, the Cyrus R. Vance Center for International Justice (Vance Center) and the International Association of Women Judges (IAWJ).

As a result of project-related dialogue sessions, roundtables with local judges, and research into judicial security, independence, and diversity in each country, these discussion papers highlight key recommendations on supporting independent judicial associations to protect judicial independence, promote judicial diversity, and counter corruption.
