في إطار تعزيز بيئة الأعمال وتنظيمها، أقر مجلس الوزراء السعودي في 17 سبتمبر 2024 نظام الأسماء التجارية الجديد، الذي يتضمن 23 مادة تهدف إلى تحسين إجراءات تسجيل الأسماء التجارية وتلبية احتياجات السوق المتنامية.
أبرز ملامح النظام الجديد:

-تنوع الخيارات: أصبح بإمكان الشركات اختيار أسماء تجارية تضم أحرفًا وأرقامًا عربية أو أجنبية، مما يوفر مرونة في التعبير عن هويتها التجارية.

-التصرف المستقل بالأسماء التجارية: يمكن للشركات الآن التصرف في أسمائها التجارية بشكل مستقل عن المنشآت، مما يعزز مرونة إدارة الأصول التجارية.

-تعزيز الحماية القانونية: يمنع النظام الجديد تسجيل أسماء متشابهة، حتى لو اختلف النشاط، ما يقلل النزاعات ويضمن حقوق الملكية.

-إمكانية الحجز المؤقت: يُسمح بحجز الأسماء التجارية مؤقتًا قبل تسجيلها الرسمي، مع إمكانية تمديد مدة الحجز وفق اللوائح التنفيذية.

من المتوقع أن يدخل النظام حيز التنفيذ في 1 أبريل 2025، ما يعد خطوة أساسية نحو تحقيق رؤية المملكة 2030، وبناء بيئة تجارية تنافسية تعزز جذب الاستثمار وتدعم القطاع الخاص.

Today, we had the privilege of attending the third International Conference on Commercial Arbitration—an event of paramount importance, graced by the presence of eminent figures. Notable attendees included Dr. Walid Al-Samaani, the Minister of Justice, among others. The conference delved into critical issues concerning alternative dispute resolution, with a particular focus on the pivotal role of arbitration.

Discussions revolved around the Ministry of Justice's active role in promoting and strengthening arbitration as a dispute resolution option, emphasizing its contribution to fostering confidence in arbitration rulings—rendering them non-appealable except before the Supreme Court. Participants voiced their opinions, emphasizing that arbitration and mediation stand as superior and expeditious methods for resolving disputes due to their cost-effectiveness and their role in restoring rights and preserving ongoing business relationships.

Our visit to the exhibition booths of sponsor companies, such as Aramco, highlighted the incorporation of arbitration clauses in all their contracts. Additionally, we explored Najz's booth, where a novel service called "Settlement" was introduced, offering a means of dispute resolution without the need for litigation.

Throughout the conference, engaging with fellow lawyers and participants facilitated the exchange of experiences and knowledge.
