If you have completed 5 years of legal residence in Portugal, are about to do so, or are planning the next steps of your life project in the country, this article may be of interest to you.

⚠️ With the recent changes to the Portuguese Nationality Law, many foreign residents will no longer be able to apply for Portuguese nationality after 5 years of legal residence in Portugal. However, this does not mean that the 5-year milestone has lost its relevance.

On the contrary, this may be the right moment to assess legal mechanisms that can help strengthen your legal position in Portugal and, in some cases, enhance your mobility within the European Union.

The decree amending the Nationality Law has been promulgated, following its approval by the Assembly of the Republic.

The legislation will now proceed through the remaining legal steps before entering into force, marking one of the final stages of the legislative process.

📢 Nationality Law under review!

The Socialist Party has requested a preventive review by the Constitutional Court regarding the provision establishing loss of nationality as an ancillary penalty for serious crimes, reopening the debate on this issue.

It should be noted that the Constitutional Court has previously ruled this solution unconstitutional, raising renewed questions about its legal sustainability.

This development comes at a time when the broader amendment to the Nationality Law is awaiting the President’s decision, leaving the next steps of the legislative process open.

📢 Nationality Law: a decisive moment for pending applications

The proposed amendments to the Nationality Law were submitted to the President of the Republic for promulgation on April 13.

From this point onwards, the constitutional deadlines apply: 20 days for promulgation or veto and 8 days for a potential request for preventive review, as seen in 2025.

In this context, the issue of pending applications becomes particularly relevant and how they may be affected by the new rules.
