Funchal has a new Alojamento Local regulation. Regulation No 787/2026, in force since 30 June 2026, prohibits new AL registrations across the whole municipality, with a closed list of exceptions covering older and rehabilitated buildings, rehabilitated vacant buildings, buildings rebuilt on safety grounds and a ceiling of six apartments per building. Registration is barred where a residential lease has been in force in the last two years, and the apartment and guest-house modalities are compatible only with commerce and services uses. Existing registrations are not cancelled but become subject to new obligations on waste, guest information, water tariff and the display of the registration number.

A new arbitral ruling changes the arithmetic for anyone selling a property that was registered for alojamento local. CAAD decision 1036/2025-T holds that a sale within three years of moving the property back to personal assets is taxed under category B rules in full, including the 25% rate for non-resident owners (the tax authority had applied an effective 49.68%).

After five years of legal residence, a foreign national in Portugal moves off the cycle of temporary permits and onto a stable, long-term footing. What many overlook is that two distinct statuses open at that same milestone, not one.

Permanent residence, under Article 80.º of Lei n.º 23/2007, is a national status securing the right to live and work in Portugal indefinitely, with the card renewed every five years as a formality. EU long-term resident status, under Article 126.º, delivers the same stability and adds facilitated mobility to other Member States. They are complementary, not mutually exclusive, and an eligible applicant may hold both.

The distinctions matter in the detail. The "no conviction in the last five years" condition belongs to permanent residence; for the EU status the test is a public-order and public-security assessment, not a fixed five-year window. The absence rules differ too: permanent residence tolerates up to 24 consecutive or 30 interpolated months over three years, while the EU status is lost through absence from the EU beyond 12 months or from Portugal beyond six years. The right choice turns on whether the priority is stability in Portugal or mobility across the Union.

The Portuguese citizenship requirements changed on 19 May 2026, when Lei Orgânica n.º 1/2026 entered into force and republished the Nationality Law. The eligibility bar has moved, but the rulebook that tells applicants how to clear it is not yet complete.

The qualifying period of legal residence rose to seven years for CPLP and EU nationals and to ten years for other nationalities, and the count now starts from the issuance of the residence title rather than from when the application for it was lodged. Applicants must also prove knowledge of the Portuguese language, culture, history and national symbols, of the fundamental rights and duties of citizenship and of the organisation of the State, and make a solemn declaration of adherence to the rule of law.

The document to watch is the amended Nationality Regulation, due by 16 August 2026, which will fix how the new knowledge tests are administered and how the recalculated residence period is evidenced. Applications pending on 19 May 2026 continue under the previous rules. Until the regulation is published, building the documentary record and confirming your residence dates is the prudent course.

The choice between Portugal's D7 and D8 visas comes down to one question: is your income passive or earned? Applying under the wrong category is one of the most common, and most avoidable, reasons for refusal.

The D7 is for holders of regular passive or own-source income, classically pensions, dividends and rent, and asks for monthly income equal to the national minimum wage (about EUR 920 in 2026). The D8 is the dedicated remote-work route, for people actively earning from employers or clients outside Portugal, and asks for four times that figure (EUR 3,680). Both add 50 per cent for a spouse and 30 per cent per child.

Income type, not level alone, decides the category: presenting active salaried income on a D7 increasingly invites refusal. Beyond that the two share most of their machinery, the same two-stage process, the same two-year permit renewable for three, the same five-year route to permanent residence. And neither confers the 20 per cent IFICI rate automatically; that depends on the activity performed.
