Circular Regarding Trademark Procedures Before Trademark Registrar in Gaza

We would like to inform you that we have received information indicating that the Trademark Registrar in Gaza has resumed operations, including the processing of pending trademark matters and the acceptance of new applications, in accordance with the procedures currently in place.
In this regard, please note the following:
1. Pending matters require the resubmission of certain documents and supporting materials in order for the registration process to resume.
2. There has been no change to the official government fees, which remain the same as previously applicable.
3. Government fees are currently required to be paid in cash to the competent authority, against the issuance of an official payment receipt.
4. Due to the current operational and financial circumstances, transferring funds into the Gaza Strip involves additional transfer costs and commissions imposed by the available payment channels. These additional costs may be reflected in the total amount required to proceed with the relevant procedures.
5. With respect to oppositions, the period for filing oppositions against the trademark registration applications published in Issue No. 70, dated 15 August 2023, has been extended until 11 August 2026.
While our firm remains committed to providing legal and intellectual property services to our clients throughout all Palestinian territories, we would also like to emphasize that the current circumstances remain exceptional. Accordingly, the progress of trademark matters is subject to factors beyond our control, including the procedures adopted by the relevant authorities, as well as the prevailing logistical and financial conditions.
Furthermore, any decision to proceed with pending matters or to file new trademark applications will be implemented only upon the client’s explicit instructions after considering the above circumstances. Please note that our firm shall not be held responsible for any delays, inability to proceed, or other consequences arising from the current exceptional circumstances or from any changes to the procedures adopted by the relevant authorities.

تعميم بشأن إستئناف العمل أمام مسجل العلامات في قطاع غزة
نود إعلامكم بأنه قد وردتنا معلومات تفيد باستئناف العمل لدى مسجل العلامات التجارية في قطاع غزة، بما يشمل استكمال إجراءات الملفات القائمة واستقبال طلبات جديدة، وذلك وفقاً للآليات المعمول بها حالياً. وفي هذا الإطار، نود إحاطتكم علماً بما يلي:
1. تستوجب الملفات القائمة إعادة تقديم بعض المستندات والوثائق اللازمة لاستكمال الإجراءات.
2. لم يطرأ أي تعديل على الرسوم الحكومية الرسمية، وما زالت الرسوم المعمول بها سابقاً سارية دون تغيير.
3. يتم حالياً سداد هذه الرسوم نقداً لدى الجهة المختصة مع الحصول على إيصال رسمي بالسداد.
4. ونظراً للظروف التشغيلية والمالية القائمة، فإن تحويل الأموال إلى داخل قطاع غزة يترتب عليه تكاليف وعمولات إضافية تفرضها آليات التحويل المتاحة، وقد تنعكس هذه التكاليف على المبالغ المطلوبة لاستكمال الإجراءات.
5. بخصوص الاعتراضات: فقد تم تمديد فترة تقديم الاعتراضات على طلبات تسجيل العلامات التجارية المنشورة في العدد رقم (70) الصادر بتاريخ 15/8/2023 وذلك حتى تاريخ 11/8/2026.
وإذ يحرص مكتبنا على الاستمرار في تقديم خدماته القانونية والمهنية لجميع موكليه في مختلف الأراضي الفلسطينية، فإننا نؤكد في الوقت ذاته أن الظروف الحالية لا تزال استثنائية، وأن سير الإجراءات يخضع لعوامل خارجة عن إرادتنا، بما في ذلك القرارات والإجراءات المتبعة لدى الجهات الرسمية والظروف اللوجستية والمالية السائدة.
وعليه، فإن أي قرار بالمضي قدماً في استكمال الإجراءات أو تقديم طلبات جديدة سيكون بناءً على تعليمات الموكل الصريحة بعد الاطلاع على الظروف المشار إليها أعلاه، مع العلم بأن مكتبنا لا يتحمل أي مسؤولية عن أي تأخير أو تعذر أو آثار قد تنجم عن الظروف الاستثنائية الحالية أو عن أي تغييرات قد تطرأ على آليات العمل لدى الجهات الرسمية.
