Did you know that the employment agency in Poland is perhaps the most popular business among foreigners?
In order to open an employment agency in Poland, you must:
✅Company registration
The first step of the enterprise individual entrepreneur must be registered. (You can read this information in previous posts). Do three things:
1) Decide which form is the most suitable.
2) Check out the articles in the previous post by choosing vour form.
3) Perform the registration steps described in the selected material.
The result of the stage should be the presence of a registered company or individual entrepreneur under Polish law, including the presence of all necessary identifiers (PESEL / NIP, REGON, KRS, etc.). Don't forget that activity codes 78.10.Z or 78.20.Z mentioned above should be clearly indicated.
Obtain a certificate of inclusion of the company in the register of enterprises that operate employment agencies (KRAZ).
There are two such certificates:
- to the activity of an intermediary in the field of employment, and
- for the activities of a temporary employment agency.
Such a certificate can be issued by a Polish company that:
a) has no debts in Poland for taxes, fees and obligatory payments;
b) is not in bankruptcy or liquidation;
c) whose manager does not have a criminal record for violations in the field of employment.
The state fee for entering into the register and obtaining a certificate is PLN 200. The entire paperwork process takes about 1-2 weeks.

Employment agencies entered in the register are obliged at the end of each year to submit a detailed report on their work to the Voivodeship Labor Office at the place of registration.
In addition, they must avoid tax and duty arrears for their employees, as well as comply with the statutory rules for the protection of personal data (RODO).

🟢Assignment (assignment) - the process of transferring rights and obligations under the Lease Agreement from the current lessee (Assignor) to another legal entity, or with subsequent redemption to an individual (Assignee).
📌In simple words, concluding an assignment agreement is an opportunity to transfer a leasing agreement to another person.
The ownership of the vehicle, as property, remains with the lessor until the end of the contract, and simply selling or transferring them to a new owner will not work.
📌The Lessee has the right to apply to the Lessor with a request to assign the Lessee's rights under the Lease Agreement to a third party no later than 2 (two) months before the date of the last payment provided for in the Payment Schedule of the Lease Agreement. In this case, the assignment of rights is possible only subject to the written consent of the Lessor to conclude an assignment agreement, the terms of which are agreed in writing with the Lessor.
📌Please note that the assignment of rights is not free of charge. When concluding an assignment agreement between the current lessee and the assignee, the contractual amount for the transfer of rights and obligations under the leasing agreement (the provable value of the transfer of rights under the leasing agreement) must be established.
