Our colleagues from the Chair of European Legal Tradition have published a new book on equality in exchange upon the Polish law, albeit in comparative perspective. The book provides some proposals de lege ferenda on the occasion of recent (30th June) amendment of the Polish Civil code (Art. 388).

Concerning Transnational law, Dr. iur. Aleksander Grebieniow has written a chapter on unfair advantage in the most modern transnational legal doctrine.

Today (on 6th June 2022) our colleague, Dr. iur. Aleksander Grebieniow delivered remotely a lecture "A Common Contract Law in Asia?" within the Trisakti Law Lecture Series, at the Trisakti Faculty of Law, Jakarta (Indonesia).

Discussed were the attempts for harmonisation of Contract law in Asia and the place of draft Principles of Asian Contract Law in the realm of Transnational law. Apart from theoretical inquires, the main issue - is the harmonisation of law in Asia at all feasible - has been discussed.

The Principles of Asian Contract Law (PACL) are the most recent addition to the series of uniform laws regarding transnational commercial contracts. This time, the harmonization initiative must address the problem of a great variety of legal traditions, all of which are quite difficult to reconcile. The author focuses on the object and objectives of the PACL by reconsidering the notion of “Asian law” and the alleged cultural neutrality of contract law as a legal discipline. The paper argues that the PACL project lacks clarity. Its ambitious objectives, while apparently intelligible, fail to produce the desired results in their entirety: the Asian regional harmonization of contract law turns out to resemble its occidental forerunners. The study goes beyond the traditional comparative law. It explores the model law (in the making) in a broader context of legal policy, parallel regional private-law-making efforts in the field of contract law as well as in the context of legal globalization.

Welcome to the fanpage of the newly established Warsaw Centre for Transnational Law.

Warsaw Centre for Transnational Law established at the Faculty of Law (University of Warsaw) conducts research in Transnational & Comparative law. WCTL's director is Prof. Dr. Jakob F. Stagl, supported by Dr. iur. Aleksander Grebieniow and PhD candidate Igor Adamczyk.

We focus on researching the interrelations of the legal systems that transcend the borders of states. In particular we pay attention to the fact that transnationalization of law is a perennial phenomenon that can be traced back far into the past. We combine historical and comparative research (law in time and in space). The systematics of Roman law, the pehnomenon of legal harmonisation and mixtures of legal traditions count currently to our core topics.
