🚨Latest news regarding visas to Poland 🚨

The Polish government has published data for the first quarter of 2026, compared with 2021 and 2022.

👉🏻 I would like to quote some of the key statements made directly by the government:

⚠️ “In order to protect the labour market, we have successfully reduced abuses related to the issuance of work permits and work visas for Poland.”

⚠️ „Documents are now issued only to those foreigners whose presence brings real benefits to the Polish economy and does not pose a threat to national security.”

⚠️ „By restoring Polish migration policy to the right track, Poland is managing migration processes in a sovereign manner, guaranteeing state stability and public security, which remain a priority for the current government.”

⚠️ “The adjustment of Poland’s migration policy was a necessary response to serious crises and shortcomings that the country faced just a few years ago. Uncontrolled migration flows and the mass, irresponsible issuance of visas were among the main reasons for introducing a new approach. A significant problem was also the misuse of student visas as a gateway to the Schengen Area without any genuine intention to study. In addition, obtaining work permits merely for appearance’s sake became a widespread practice, destabilising the domestic labour market.”

⚠️ „The government and individual ministries have introduced measures in recent months to strengthen the system and prevent abuses of migration procedures.”

👉🏻 This is a real reflection of everything many of you already know from your own experience when applying for work visas, student visas or visas for your family members. Unfortunately, it does not appear that the process will become easier in the near future.

📊 W pierwszym kwartale 2026 r. Polska wydała 16 tys. wiz pracowniczych dla cudzoziemców – to osiem razy mniej niż w tym samym okresie 2022 r. Ponadto, wydaliśmy kilkadziesiąt procent mniej wiz studenckich, ponad połowę mniej zezwoleń na pracę i zapewniliśmy skokowy wzrost skutecznych deportacji.

✅ Polski rząd wdrożył nową, asertywną i selektywną politykę migracyjną, której kluczowymi priorytetami są bezpieczeństwo obywateli oraz odpowiedzialne podejście do migracji. 🌐

🇵🇱 Dzięki uszczelnieniu procedur i konsekwentnemu egzekwowaniu prawa, państwo odzyskało kontrolę nad tym, kto i w jakim celu przyjeżdża do Polski i kto musi go opuścić. ➡️ Podejście rządu opiera się na założeniu, że imigracja musi przynosić realne korzyści i być adekwatna do wydolności państwa oraz nie wpływać negatywnie na spójność społeczną

Important issue connected to MOS 👾!

The digitalisation of residence procedures has attracted cybercriminal activity.

👾 There have been reports of phishing emails impersonating official MOS correspondence. These emails refer so far to signing “Attachment No. 1” and contain a link to an employer portal.

👾 If someone does not carefully verify the email address and clicks on a fake message, there may be a risk of downloading malicious software or compromising personal data.

At this stage, our law office has not personally encountered such situation in cases handled by us. However, the issue appears serious enough that we believe it is important to mention it and raise awareness.

You probably won’t believe this, but more big changes in residence procedures may be coming this year 🙃

What can change?

❗️❗️ some foreigners could automatically receive a temporary residence permit if the office does not issue a decision within the required time

❗️the new system would apply only to citizens of selected countries considered “low migration-risk” in terms of migration and security

👉🏻 the list of such countries will be decided in future

👉🏻 the changes would apply only to citizens of such countries that can visa-free travel to the EU

❗️the case could be considered approved after 60 days from submitting a complete application

⚠️ the changes would not apply to appeal proceedings before the Head of the Office for Foreigners

⚠️ “silent approval” would not be possible if the foreigner appears in SIS, on the list of undesirable foreigners, or if there are security or public order concerns

⚠️ security checks could still continue even after the “silent approval” & until those checks are completed, the foreigner may not receive a residence card

⚠️ in some situations, the foreigner would still need to appear in person after the “silent approval”.

📌 In practice, this could significantly shorten the real waiting time for citizens of selected countries considered by low migration-risk.
📌 So unfortunately, these changes would not apply to everyone.
📌 Considering that citizens of some countries would be excluded from these changes, the new system may lead to unequal treatment of foreigners in similar legal situations.

I’m already after first applications submitted through the new MOS and I can see that some problems will also come from seemingly small technical issues (also on your side!).

Today submitting of another application suddenly turned into a chain of unexpected problems, all caused by small technical details that many people normally do not pay much attention to 🫠

The client had a PESEL number, access to online banking and all the required documents prepared, so everything seemed ready to go smoothly. The problem appeared already when we tried to create a Trusted Profile (Profil Zaufany), which is now necessary to submit an application in MOS.

It turned out that the bank account was originally opened without a PESEL number and it had never been updated in the system. On top of that, the account was linked to an old e-mail address that the client no longer had access to 🙉

Before we could continue with the application, the technical issues had to be sorted out first.

🧩 This is a very good example that not only documents and legal regulations matter now, but also things that many people previously treated as minor details.

⚠️ Such things are now starting to have a real impact on whether your application can be submitted.

The new system was supposed to simplify procedures, but in practice many technical issues and confusing situations are already appearing, especially for foreigners trying to navigate the process.

✅ That is why I always recommend checking and preparing these things earlier, before starting the application process, instead of dealing with them later under time pressure and stress.
