⚖️ CASE LAW INSIGHT
📌 PLJ 2026 Cr.C. 191
The Court held that courts can exercise only such jurisdiction as is vested in them by the Constitution or law.
In matters concerning the offence of “polygamy”:
🔹 The Family Courts have jurisdiction to conduct the trial under the Family Courts Act, 1964.
🔹 Appeals arising from such decisions are to be adjudicated by the District Court under Section 14 of the Family Courts Act, 1964.
🔹 Consequently, the Court of Sessions lacked jurisdiction to entertain the appeal, as the proper appellate forum was the District Court, not the Court of Sessions.
📚 Key Point:
Jurisdiction must be exercised by the forum specifically empowered by law.
