ہوم ریمٹنس (Home Remittance) پر ٹیکس چھوٹ: قانون، شرائط اور اعلیٰ عدالتوں کے فیصلے - قسط نمبر 5
ابتدائی تعارف:
پاکستان میں بیرونِ ملک مقیم پاکستانی جب اپنے اہل خانہ کو رقم بھیجتے ہیں تو اُسے ہوم ریمٹنس کہا جاتا ہے۔ اس پر عمومی طور پر کوئی انکم ٹیکس نہیں لگتا، لیکن یہ چھوٹ کچھ شرائط سے مشروط ہے۔
فیڈرل بورڈ آف ریونیو (FBR) 5 ملین روپے سالانہ تک موصول ہونے والی Remittance پر ذرائع آمدن (source) نہیں پوچھتا، لیکن اگر رقم اس حد سے تجاوز کرے تو FBR دستاویزات مانگنے یا پوچھ گچھ کا حق رکھتا ہے۔
مزید برآں، FBR اس بات کا بھی جائزہ لیتا ہے کہ رقم بھیجنے والا (Remitter) قریبی خونی رشتہ دار ہے یا کوئی بے نامی شخص۔
قانونی بنیاد – سیکشن 111(4)، انکم ٹیکس آرڈیننس 2001
سیکشن 111(4) کے مطابق:
“اگر کوئی شخص بینکاری ذرائع سے غیر ملکی زرِ مبادلہ حاصل کرے اور شیڈول بینک سے انکیش کروا کر اس کا سرٹیفکیٹ پیش کرے، تو وہ رقم آمدنی تصور نہیں ہوگی، اور اس پر ٹیکس نہیں لگے گا۔”

قانونی چھوٹ حاصل کرنے کی شرائط:
بینکاری ذریعہ
رقم پاکستان میں کسی تسلیم شدہ بینک (Scheduled Bank) کے ذریعے آئے
Encashment
رقم پاکستانی روپے میں تبدیل کی جائے
PRC سرٹیفکیٹ
Proceeds Realization Certificate لازمی حاصل کیا جائے
حد
5 ملین روپے سالانہ تک FBR ذریعہ نہیں پوچھے گا
اضافی دستاویزات
5 ملین سے زائد رقم کی صورت میں Remitter کی شناخت، رشتہ داری، CNIC یا Passport کی کاپی، بیرونِ ملک ملازمت کا ثبوت پیش کیا جا سکتا ہے.

کون ہونا چاہیے Remitter
FBR درج ذیل خونی رشتہ داروں یا قریبی فیملی ممبرز سے بھیجی گئی Remittance کو قابل قبول سمجھتا ہے:
والد، والدہ
بیٹا، بیٹی
بہن، بھائی
شریکِ حیات
اگر کوئی غیر متعلقہ فرد remittance بھیج رہا ہے تو FBR پوچھ سکتا ہے کہ رقم کی نوعیت کیا ہے۔

اہم عدالتی نظائر (Expanded Case Laws):
1. Army Welfare Sugar Mills Ltd. v. Federation of Pakistan (1992 SCMR 1652)

خلاصہ:
عدالت نے فیصلہ دیا کہ ٹیکس سے متعلق کسی بھی چھوٹ کے لیے قانون میں دی گئی شرائط کو مکمل طور پر پورا کرنا لازم ہے۔ اگر کوئی ٹیکس دہندہ قانونی تقاضے پورے کیے بغیر چھوٹ کا دعویٰ کرتا ہے تو وہ دعویٰ قابل قبول نہیں۔ اس کیس میں FBR کا مؤقف تھا کہ remittance کا ذریعہ اور طریقہ شفاف نہیں تھا۔
2. CIR v. Ameer Abdullah Khan Rokhari (PTR No.83 of 2012
فورم: لاہور ہائی کورٹ
خلاصہ:
اس کیس میں ٹیکس دہندہ نے ہوم ریمٹنس کو ظاہر کیا اور اس کے ساتھ بینک سے جاری کردہ PRC بھی فراہم کیا۔ عدالت نے FBR کے اعتراضات کو رد کرتے ہوئے کہا کہ جب تمام تقاضے مکمل ہوں تو صرف شک کی بنیاد پر remittance کو آمدنی قرار نہیں دیا جا سکتا۔
3. Civil Petition No. 2100/2024
فورم: سپریم کورٹ آف پاکستان
خلاصہ:
FBR نے ایک شہری کو 6 ملین روپے کی ریمٹنس پر نوٹس جاری کیا۔ شہری نے remitter کے شناختی دستاویزات، PRC اور SWIFT تفصیلات فراہم کیں۔ عدالت نے FBR کے اقدام کو غیر قانونی قرار دیتے ہوئے شہری کو ریلیف دیا اور قرار دیا کہ اگر remittance کا قانونی ثبوت ہو تو FBR اس پر سوال نہیں اٹھا سکتا۔

اہم نکات (Takeaways):
ہوم ریمٹنس پر ٹیکس سے چھوٹ صرف اسی وقت حاصل کی جا سکتی ہے جب وہ بینکنگ چینل سے ہو اور PRC موجود ہو؛
خونی رشتہ داروں سے موصول شدہ رقوم پر FBR نسبتاً کم اعتراض کرتا ہے؛
5 ملین روپے سے کم کی ریمٹنس پر ذرائع کا سوال نہیں کیا جاتا، بشرطیکہ ثبوت مکمل ہو؛
عدالتی نظائر FBR کو پابند کرتے ہیں کہ وہ شواہد کی بنیاد پر کارروائی کرے نہ کہ شک کی بنیاد پر۔
اختتامیہ:
ہوم ریمٹنس پر ٹیکس سے چھوٹ ایک بڑی سہولت ہے، لیکن اس کے لیے ضروری ہے کہ تمام قانونی تقاضے مکمل کیے جائیں۔ Encashment Certificate اور remitter کی تفصیلات مکمل ہوں تو FBR کو قانونی طور پر اعتراض کا کوئی جواز نہیں رہتا۔ ٹیکس دہندگان کو چاہیے کہ وہ PRC کو محفوظ رکھیں اور سالانہ 5 ملین سے زائد ریمٹنس کی صورت میں اضافی دستاویزات تیار رکھیں۔
