پاکستانی فیملی لاء میں "خلع بشرطِ واپسی مہر" کے عدالتی نفاذ (Ex*****on of Decree) پر ایک نہایت اہم نظیر ہے۔
اس فیصلے میں عدالت نے واضح طور پر قرار دیا کہ اگر خلع کی ڈگری مہر کی واپسی سے مشروط ہو، تو شوہر اس ڈگری کی بنیاد پر مہر کی واپسی کیلئے "اجراء (Ex*****on Petition)" دائر کر سکتا ہے۔

📜 پس منظرِ مقدمہ (Case Background):

شوہر (درخواست گزار) اور بیوی (مدعا علیہہ) میں ازدواجی اختلافات پیدا ہوئے۔

بیوی نے خلع کی بنیاد پر تنسیخِ نکاح کا دعویٰ دائر کیا۔

فیملی کورٹ نے 8 دسمبر 2010 کو خلع کی ڈگری جاری کی بشرط واپسی حقِ مہر (۴ تولہ سونا)۔

بعد ازاں شوہر نے اجراء کی درخواست (Ex*****on Petition) دائر کی تاکہ مہر واپس لیا جا سکے۔

لاہور ہائی کورٹ (W.P.) اپیل منظور کی — شوہر کو حقِ اجراء دیا ADJ کا فیصلہ کالعدم

⚖️ فریقین کے مؤقف (Arguments of the Parties):

درخواست گزار (شوہر):

خلع کی ڈگری میں واضح طور پر لکھا ہے کہ “خلع بشرطِ واپسی مہر منظور کی جاتی ہے”۔

لہٰذا یہ ایک مکمل ڈگری (compound decree) ہے جو قابلِ نفاذ (executable) ہے۔

فیملی کورٹ کا فیصلہ درست اور قانونی ہے۔

مدعا علیہہ (بیوی):

اجراء کی درخواست ناقابلِ سماعت ہے۔

صرف "خلع" دی گئی ہے، مہر کی واپسی کے لیے الگ دعویٰ دائر کرنا ضروری ہے۔

ریویژن کورٹ (ADJ) کا فیصلہ درست تھا۔

📖 عدالتی مشاہدات (Court’s Observations):

1. خلع بشرطِ واپسی مہر "Compound Decree" ہے

عدالت نے کہا کہ جب فیملی کورٹ خلع دیتے ہوئے واپسیِ مہر کی شرط لگاتی ہے،
تو یہ فیصلہ دو حصوں پر مشتمل ہوتا ہے:
1️⃣ نکاح کی تنسیخ
2️⃣ مہر کی واپسی

لہٰذا یہ ایک مکمل ڈگری ہے جس کا نفاذ ممکن ہے۔

> "Such a decree dissolves marriage and simultaneously directs the return of dower — hence it is executable in law."

2. سیکشن 13 (فیملی کورٹ ایکٹ 1964) کے تحت نفاذ کا حق

عدالت نے سیکشن 13 کا حوالہ دیتے ہوئے کہا کہ
اگر کسی ڈگری میں مالی ادائیگی یا واپسی کا ذکر ہو،
تو عدالت اس کے نفاذ کیلئے اجراء کے طریقہ کار اختیار کر سکتی ہے۔

مہر چونکہ مالی حق ہے، لہٰذا اسی ڈگری کی بنیاد پر شوہر کو اجراء کا حق حاصل ہے۔

3. مناسب عدالتی فارم اور رجسٹریشن (Rules 16 & 17 FCR 1965)

عدالت نے کہا کہ خلع کی ڈگری فارم I کے مطابق تیار کی گئی،
جس میں مہر کی واپسی کی شرط درج ہے،
اس لیے یہ ایک قاعدہ 16 کے مطابق مکمل ڈگری ہے۔

4. سابقہ نظیر (Distinction from Nadia Bibi Case, PLD 2013 Lahore 41)

عدالت نے واضح کیا کہ Mst. Nadia Bibi Case میں خلع بغیر کسی شرط کے دی گئی تھی،
اس لیے وہاں اجراء ممکن نہیں تھا۔

مگر موجودہ کیس میں واپسی مہر کی شرط موجود ہے،
اس لیے یہ قابلِ نفاذ ڈگری ہے۔

⚖️ عدالتی فیصلہ (Judgment):

عدالت نے قرار دیا کہ:

خلع بشرط واپسی مہر ایک قابلِ نفاذ ڈگری ہے۔

شوہر کو اجراء (Ex*****on Petition) دائر کرنے کا مکمل حق حاصل ہے۔

ایڈیشنل ڈسٹرکٹ جج کا فیصلہ غلط اور غیرقانونی تھا۔

نتیجتاً، ہائی کورٹ نے ریویژن کورٹ کا فیصلہ کالعدم قرار دے کر شوہر کی درخواست منظور کر لی۔

عدالتِ عالیہ نے یہ اصول قائم کیا کہ
اگر عورت کو خلع کی ڈگری مہر کی واپسی کی شرط پر دی جائے،
تو شوہر بغیر نیا مقدمہ دائر کیے
اسی ڈگری کے تحت فیملی کورٹ میں اجراء کی درخواست دے سکتا ہے۔
ایسی ڈگری دونوں فریقین کے حقوق و فرائض کو مکمل طور پر
متعین کرتی ہے۔
