The Peshawar High Court ruled in favor of the petitioner in the writ petition of said Muhammad versus ANF and others, setting aside the decisions of the Special Court for Prevention of Smuggling and the Appellate Tribunal for Prevention of Smuggling, and remanded the case back to the trial court for a fresh hearing and judgment, taking into account the petitioner's property acquired through lawful means of purchase and inheritance.
Our senior partner, Ziaur Rahman Tajik Advocate Supreme Court, appeared on behalf of the petitioner before the High Court.

Pre-Arrest Bail (BBA) Confirmed

​The accused petitioner’s application for Bail Before Arrest (BBA) was initially dismissed on merit by the Court of Sessions. Following this dismissal, a BBA application was competently filed before the High Court under the doctrine of utilization of forums.,the Code of Criminal Procedure (CrPC) contains no barring provision that precludes an accused from seeking pre-arrest bail from the High Court after such relief has been declined by a lower court.The accused petitioner was not named in the First Information Report (FIR). His involvement was only alleged through statements recorded under Section 161 CrPC, which were delayed by seven days following the occurrence.
The prosecution failed to explain the "source of satisfaction" how the complainant supposedly discovered the accused’s involvement a week after the incident.

The Peshawar High Court has rejected the writ petition filed by Mahmood ul Hassan seeking quashment of the FIR, titled Mahmood ul Hassan vs. SHO Police Station Nowshera Cantt and others.

In the case of Jabir Khan versus Federation of Pakistan, the Peshawar High Court has allowed the writ petition and prohibited the practice of interviewing accused individuals while in police custody and during investigation. Consequently, interviews of accused persons by social media activists and YouTubers are strictly forbidden.
The petitioner was represented by Ziaur Rahman Tajik, Advocate of the Supreme Court and Senior Partner.
