Pakistan's Supreme Court's larger bench has commuted the accused petitioner's death sentence on two counts to life imprisonment. It has been clarified before Pakistan's Supreme Court that Section 311 is compoundable and is attracted to cases in which the accused has been convicted under Section 302(a), but not in cases of conviction as tazir under Section 302(b) of the Pakistan Penal Code. And the present case accused petitioner was convicted only under Section 302(B) and Tazir punishment has been awarded to him. And the compromise was wrongly not considered in contravention of the principles laid down in PLD 2015 SC 77.

The bail application bearing the title Muhammad Numan versus The state, etc., is allowed by the Peshawar High Court, and the applicant is released on bail in the offence of 489-F etc. of the Pakistan Penal Code. Because the sign on the cheque has no resemblance with the sign of the Applicant. The partnership deed was not worth consideration and was doubtful.; The Complainant also failed to establish business transactions with the application, giving of amount as debt, sale and purchase of the vehicles with the applicant. Financial murder and involvement of a heavy amount of 1 crore and 11lacs are no grounds for refusal of bail because 489F has been punishable for 3 years without any distinction of quantum of amount. In the Civil revision petition bearing the title Waheed khan versus Shahzada khan, the respondent is put on notice and operations of the impugned judgement and proceedings before the trial court are suspended by the Peshawar High Court.
Because the leave to defend the suit is filed without an affidavit and an affidavit is filed later on after the prescribed period of 10 days provided by article 159 of the Limitation Act reasonable defence has been mentioned in the leave to defend application which needs recording of evidence and framing of issues. Also, no opportunity for a hearing is provided to the petitioner while accepting the affidavit of the respondent under order 37 rule 3 of the civil procedure code in violation of principles of Nature Justice, Article 4 and 10-A of the constitution of the Islamic Republic of Pakistan. The Trial was bound under the mandate of Article 37 Rule 3 of the civil procedure code to have decreed the suit because the cheque of Rs 28 crore was dishonoured on presentation and the presumption of truth was also attached to the bank cheque under section 118 of The Negotiable instrument Act.
