Advocate Ali Gohar Durrani appeared on behalf of the petitioner while Assistant Attorney General Ishaq Khalil represented the federal government and FIA Deputy Director Shahbaz Noor was also present.
The PHC issued a written order in this regard, according which, the federal authorities must explain in their report the reasons for including the petitioner’s name in the relevant list.The bench remarked that freedom of movement, personal liberty, and the right to earn a livelihood are fundamental rights under the Constitution of Pakistan. Articles 15, 18, and 25 of the Constitution provided protection to every citizen.
The court further observed that any restriction on fundamental rights could only be imposed in accordance with the law and on transparent grounds, and that before imposing such restrictions, the affected person must be given an opportunity of being heard.
“Arbitrary actions or steps taken without fulfilling legal requirements are unacceptable,” the order said.According to the order, solid and justifiable reasons were required for placing a citizen’s name on the ECL, PNIL, or PCL, and it was mandatory to inform the concerned person in writing in a timely manner. “Failure to inform the affected individual amounts to a violation of fundamental rights and principles of natural justice,” the order read.
The court also directed the authorities to strictly adhere to constitutional safeguards and legal requirements, warning that it would not hesitate to take strict action against any illegal move by exercising its constitutional powers.
