PESHAWAR: The Peshawar High Court has issued notices to Shaheed Benazir Bhutto Women University (SBBWU), Peshawar, and called for comments in a petition challenging the withholding of a student’s degree and academic documents over an alleged outstanding amount of approximately Rs130,000, despite her academic expenses being covered under an HEC-funded scholarship.

The case was heard by a bench comprising Justice Arshad Ali and Justice Babar Sattar.

The petitioner, Ruqaya Yousaf, a former BS Chemistry student of SBBWU, has approached the high court seeking a declaration that the demand raised by the university is illegal, arbitrary and unconstitutional.

Through her petition, filed through Advocate Saifullah Muhib Kakakhel, she has also challenged the university’s decision to withhold her degree, transcript and other academic documents and has sought directions for the university to reconcile her account in accordance with the official scholarship record maintained by the Higher Education Commission (HEC).

The petitioner has further requested the court to direct the university to waive or adjust the alleged outstanding dues which, according to her, were covered under the HEC Need-Based Scholarship Programme.
The respondents include the Vice-Chancellor of SBBWU, Controller of Examinations, Scholarship In-charge and the Regional Director of HEC.

According to the petition, Ruqaya Yousaf was a regular student of the BS Chemistry programme at SBBWU and successfully completed all academic requirements for her degree in 2025.

During her studies, she was selected as a beneficiary of the HEC Need-Based Scholarship Programme on the basis of merit and financial need. The petitioner maintains that the scholarship was fully funded and covered tuition fees and other approved academic expenses for the duration of her degree programme.

After completing her degree, the petitioner applied to the university for issuance of her degree, transcript and other academic documents. However, she was allegedly informed that she was required to pay approximately Rs130,000 towards outstanding dues relating to four semesters, and that issuance of her degree was conditional upon payment of the said amount.

The petitioner subsequently approached the Federal Ombudsperson for redressal of her grievance, where representatives of both HEC and the university appeared and were heard.

According to the petition, the HEC representative categorically stated during the proceedings that all recurring grants, including scholarship allocations up to the third quarter of the financial year 2025–26, had already been released to the university and that no financial liability was outstanding against HEC.
The petitioner has therefore contended that the university’s demand and withholding of her academic documents are without lawful justification and has sought appropriate relief from the high court.

⚖️ Peshawar High Court Sets 90-Day Timeline for Completion of Promotion Process

In an important service law judgment, the Peshawar High Court has directed completion of the promotion process within 90 days.

The case concerned delay in consideration of an eligible employee for promotion to the post of Deputy Director (BPS-18) at the University of Peshawar.

The Court observed that although promotion cannot be claimed as an automatic right, an eligible employee has a valuable and enforceable right to fair, impartial and timely consideration for promotion in accordance with the applicable rules and policy.

The Court further observed that such consideration cannot be frustrated by prolonged administrative inaction or unexplained delay.

Directions were issued for processing the pending NOC and convening the relevant Selection Board/Syndicate to consider the petitioner along with other eligible officers strictly on merit and in accordance with the applicable law, rules and University Statutes.

⚖️ The entire promotion process was directed to be completed within 90 days.
