کئی دہائیوں بعد پاکستانی شناخت بحال — عدالتی مداخلت کے بعد CNIC جاری

ایک پاکستانی خاندان کے افراد اور ان کے بچوں کے نام ماضی میں افغان سٹیزن/مہاجر کارڈز بن گئے تھے، جس کی وجہ سے انہیں اپنی پاکستانی شہریت اور شناختی دستاویزات کے حصول میں طویل عرصے تک مشکلات کا سامنا رہا۔

قانونی چارہ جوئی اور پشاور ہائی کورٹ کی مداخلت کے بعد ان کے افغان کارڈز سے متعلق رکاوٹیں دور ہوئیں اور بالآخر خاندان کو پاکستانی قومی شناختی کارڈز (CNICs) جاری کر دیے گئے۔

اس مقدمے میں خاندان کی جانب سے سیف اللہ محب کاکاخیل، ایڈووکیٹ سپریم کورٹ آف پاکستان نے پشاور ہائی کورٹ میں پیروی کی۔

یہ کیس ان افراد کے لیے اہم مثال ہے جو پاکستانی ہونے کے باوجود افغان مہاجر/سٹیزن کارڈ، ACC/POR یا دیگر ریکارڈ کی وجہ سے CNIC کے حصول یا نادرا ریکارڈ کی درستگی میں مشکلات کا سامنا کر رہے ہیں۔

پاک افغان بارڈر پر بائیومیٹرک اور Illegal Foreigner Repatriation Program (IFRP/IFLR) سے متعلق ریکارڈ بعض افراد کے لیے بعد میں NADRA verification یا شناختی ریکارڈ سے متعلق مسائل کا باعث بن سکتا ہے۔ بعض معاملات میں خاندان کے دیگر افراد کے ریکارڈ کی verification بھی درکار ہو سکتی ہے۔

اس ویڈیو میں عمومی قانونی آگاہی کے لیے بتایا گیا ہے کہ ایسے معاملات میں NADRA اور متعلقہ حکام سے verification/correction کے لیے کس طرح رجوع کیا جا سکتا ہے، اور اگر انتظامی سطح پر مسئلہ حل نہ ہو تو کیس کے حقائق اور دستاویزات کے مطابق عدالت سے قانونی remedy حاصل کرنے کا راستہ بھی موجود ہو سکتا ہے۔

کونسے افغانیوں کو عدالت سٹے دیتا ہے؟

کیا ہر افغان شہری کو عدالت سے سٹے آرڈر مل جاتا ہے؟

اس کا جواب نہیں ہے۔ عدالت ہر کیس کو اس کے اپنے حقائق، دستاویزات اور قانون کے مطابق دیکھتی ہے۔ اگر آپ کا کیس مضبوط قانونی بنیاد رکھتا ہے تو عدالت مناسب حالات میں عبوری ریلیف (Stay Order) دے سکتی ہے۔

مثال کے طور پر:

🔹 اگر آپ نے شادی کی بنیاد پر POC یا پاکستانی شہریت کے لیے درخواست دی ہوئی ہے اور آپ کا کیس ابھی زیرِ التوا ہے۔

🔹 اگر آپ کینسر، گردوں کی خرابی (Dialysis)، دل، جگر یا کسی دوسری سنگین بیماری میں مبتلا ہیں اور علاج پاکستان میں جاری ہے۔

🔹 اگر آپ پاکستان میں طالب علم ہیں، کسی یونیورسٹی یا کالج میں داخلہ لے چکے ہیں، لیکن ویزا جاری نہ ہونے یا امیگریشن مسائل کی وجہ سے تعلیم متاثر ہو رہی ہے۔

🔹 اگر آپ کا NADRA، شہریت، POC، ACC، POR یا کوئی دوسرا قانونی معاملہ متعلقہ ادارے یا عدالت میں زیرِ سماعت ہے اور فیصلہ آنے سے پہلے گرفتاری یا ملک بدری کا خدشہ موجود ہے۔

یہ یاد رکھیں کہ صرف افغان ہونا سٹے آرڈر حاصل کرنے کے لیے کافی نہیں ہوتا۔ عدالت یہ دیکھتی ہے کہ آیا آپ کے قانونی حقوق متاثر ہو رہے ہیں، کیا آپ کے پاس قابلِ اعتماد دستاویزات موجود ہیں، اور کیا آپ کا کیس واقعی عدالتی تحفظ کا مستحق ہے۔

میں نے پشاور ہائی کورٹ میں ایسے متعدد مقدمات کی پیروی کی ہے جن میں مختلف حالات کے مطابق عدالت سے ریلیف حاصل کیا گیا، لیکن ہر مقدمے کا فیصلہ اس کے اپنے حقائق اور قانون کے مطابق ہوتا ہے۔
