ہتک عزت (Defamation) کے دعوے کے اثبات کے لیے عدالت کے سامنے دو بنیادی قانونی آزمائشیں (Tests) پوری کرنا ضروری ہیں:

✍️1. معقول آدمی کا معیار (Reasonable Person Standard):

عدالت یہ دیکھتی ہے کہ کیا ایک عام معقول قاری یا سننے والا متعلقہ الفاظ کو بدنام کن (Defamatory) معنی میں لے سکتا ہے۔

✍️2. اثر کی سنگینی کا معیار (Seriousness of Impact Test):
مدعی کو یہ ثابت کرنا ہوتا ہے کہ ان الفاظ کے نتیجے میں اس کی شہرت کو حقیقی، نمایاں اور قابلِ لحاظ نقصان پہنچا ہے۔

Two tests to be applied being the reasonable person standard, assessing whether an ordinary reader would take the words as defamatory, and the seriousness of impact test, requiring proof of substantial reputational harm.

Press Release/Condemnation of Su***de attack outside Islamabad District Courts & Terrorists Attack on Cadet Collage Wana North Waziristan District.

Executive Council Peshawar High Court Bar Association, Peshawar held a virtual emergency meeting on 11-11-2025. President PHCBA, Peshawar Amin Ur Rehman Yusufzai chaired the virtual meeting. Executive Council has unanimously & strongly condemned the brutal su***de terrorist attack outside Islamabad District Courts claiming innocent lives of poor people including Lawyers. Executive Council Also Condemns the terrorist attack on Cadet Collage Wana, North Waziristan District. Such terrorist activities threatened the peaceful atmosphere of the legal fraternity as well as education of innocent tribal children.
In solidarity with Islamabad Bar Association, the Peshawar High Court Bar Association Peshawar in consultation with the members of KP Bar Council declared strike on 12th November 2025 on Principal Seat of Peshawar High Court along with Districts & Tehsil Bar Associations. There shall be no court work. Worthy members of the Bar shall not appear before the Courts.
Peshawar High Court Bar Association, Peshawar demands transparent investigation and examplary punishment for the perpetrators and also calls upon the administration to enhance the security measures.

جسٹس اطہر من اللہ نے لکھا کہ سپریم کورٹ اکثر طاقتور کے ساتھ کھڑی رہی، عوام کے ساتھ نہیں،ذوالفقار علی بھٹو کی عدالتی پھانسی عدلیہ کا ناقابل معافی جرم تھا،بے نظیر سے لیکر نواز شریف اور اب عمران خان کے ساتھ ہونے والا سلوک اسی جبر کا تسلسل ہے۔
جسٹس اطہن من اللہ نے مزید لکھا کہ اشرافیہ کے مفادات اور گرفت کو مظبوط رکھنے کیلئے عوام کی امنگوں کے ساتھ کھیلا گیا ،ہماری وفاداری عوام کے ساتھ ہونی چاہیے جن کے نام اور ویلفیئر کیلئے آئین بنایا گیا
