How to File for Khula in Pakistan — Know Your Legal Right

When a marriage becomes emotionally, mentally, or physically unbearable, Islam and Pakistani law give a woman the right to seek Khula — a legal separation initiated by the wife through court.
Here’s how the Khula process works step-by-step:
1️⃣ Filing the Case:
The wife (or her lawyer) files a Khula suit in the Family Court of her area, explaining the reasons for seeking separation.
Documents like the Nikah Nama, CNIC, and marriage details are attached.
2️⃣ Notice to Husband:
The court sends a legal notice to the husband to appear and respond.
3️⃣ Reconciliation Efforts:
The judge first attempts to reconcile the couple through counseling or meetings.
If reconciliation fails, the court moves forward.
4️⃣ Grant of Khula Decree:
If the wife insists she cannot continue the marriage within the limits of Allah, the court grants Khula
5️⃣ Union Council Procedure:
After the decree, the court sends the order to the Union Council, which issues the official Divorce Certificate after completing the legal process (usually within 90 days).
