⚖️ Supreme Court of Pakistan: Dowry Does NOT Cancel a Daughter’s Right to Inheritance

In a landmark judgment (PLD 2024 SC 1273), the Supreme Court of Pakistan ruled that daughters cannot be deprived of inheritance merely because they were given dowry or cash gifts during their father’s lifetime.

❌ Dowry is not a substitute for inheritance
❌ Brothers cannot legally exclude sisters from family property
✔ Inheritance is a protected right under Islamic law and Pakistani law

The Court also imposed a penalty of Rs. 500,000 on the petitioners for pursuing frivolous litigation and depriving their sisters of their lawful rights for decades.

PLD 2024 SC 1273

❌ Dowry, cash or gifts given to daughters do NOT cancel their inheritance rights.

In this important case, brothers tried to exclude sisters from inheritance by claiming that their father had already given them cash and dowry during his lifetime.

The Supreme Court strongly rejected this argument and held:

✅ Daughters remain legal heirs under Shariah
✅ Brothers cannot illegally retain sisters’ shares
✅ Frivolous litigation against women’s inheritance rights is intolerable
✅ Rs.500,000 costs imposed on brothers

📌 Important Clarification:
This judgment does NOT prohibit a genuine Hiba (gift) during father’s lifetime.

A valid Hiba requires:
✔ Offer
✔ Acceptance
✔ Delivery of possession

But merely claiming that daughters already received dowry or money is NOT enough to deprive them of inheritance.
