اعلیٰ تعلیمی قابلیت پر قبل از وقت سالانہ ترقیاں (Advance Increments)---حق---تعین---'ترغیبی اسکیموں' (Incentive Schemes) کا اطلاق---محکمہ آڈٹ کے افسر کے پاس ایل ایل بی کی ڈگری ہونا---اہلیت---
مختصراً، رسپانڈنٹ (مدعا علیہ) پاکستان ریلوے کے 'آڈٹ ڈیپارٹمنٹ' میں بطور اے۔او / اکاؤنٹس آفیسر خدمات انجام دے رہا تھا---اس نے 1992 میں ایل ایل بی کی ڈگری حاصل کی اور اس کے بعد 'ریلوے افسران اور ماتحت عملے کے لیے ترغیبی اسکیم 1966' اور 'پیشگی سالانہ ترقیوں کی منظوری کی عمومی اسکیم 1996' کے تحت دو ایڈوانس انکریمنٹس کی گرانٹ کا مطالبہ کیا---
محکمہ مالیات (فنانس ڈیپارٹمنٹ) نے رسپانڈنٹ کی درخواست اس بنیاد پر مسترد کر دی کہ 1966 کی اسکیم ختم کی جا چکی تھی اور اس کی تعلیمی قابلیت 1996 کی اسکیم کے دائرہ کار میں نہیں آتی، جس پر فیڈرل سروس ٹربیونل نے 1966 کی اسکیم کے تحت اس کا دعویٰ منظور کر لیا---
سپریم کورٹ کے سامنے جس نقطے کا تعین درکار تھا وہ یہ تھا کہ "کیا ایل ایل بی کی ڈگری رکھنے والا آڈٹ ڈیپارٹمنٹ کا اکاؤنٹس آفیسر مذکورہ بالا دونوں اسکیموں میں سے کسی کے تحت بھی ایڈوانس انکریمنٹس کا قانونی طور پر حق دار تھا؟"---
فیصلہ دیا گیا: 1966 کی اسکیم کے تحت آڈٹ ڈیپارٹمنٹ کے افسران کو کوئی فائدے کی توسیعات فراہم نہیں کی گئی تھیں، اور جنرل اسکیم 1996 کے تحت ایل ایل بی کی قابلیت کو تسلیم نہیں کیا گیا تھا، لہٰذا رسپانڈنٹ کا کیس کسی بھی اسکیم کے دائرہ کار میں نہیں آتا تھا---سروس ٹربیونل کی جانب سے 1966 کی اسکیم کے تحت دیا گیا فائدہ اس طرح ناقابلِ دفاع (unsustainable) تھا---مزید برآں، ایل ایل بی کی ڈگری ماسٹرز کی ڈگری کے مساوی نہیں تھی---رسپانڈنٹ دونوں میں سے کسی بھی اسکیم کے تحت ایڈوانس انکریمنٹس کا حق دار نہیں تھا---

"ریمانڈ" (Remand) کوئی خودکار عدالتی ردِعمل نہیں ہے، یہ ایک عدالتی طریقہ کار ہے جسے صرف اس وقت استعمال کیا جانا چاہیے جب انصاف کا تقاضا ہو، نہ کہ ایک معمول کے طور پر---کسی مقدمے کو نچلی عدالت میں مناسب طور پر اس وقت واپس بھیجا جا سکتا ہے جہاں بنیادی حقائق غیر متعین رہ گئے ہوں، اجرائِی انصاف (procedural fairness) متاثر ہوئی ہو، یا اہم شہادت کا صحیح جائزہ نہ لیا گیا ہو—ایسی صورت حال میں اپیلٹ کورٹ (اپیل سننے والی عدالت) خود مکمل انصاف فراہم نہیں کر سکتی---ریمانڈ کا مقصد اصلاحی ہے، التوا کا شکار کرنا نہیں؛ یہ منصفانہ فیصلے کو یقینی بنانے کے لیے ہے، مقدمہ بازی کو طول دینے کے لیے نہیں---
تاہم، ریمانڈ کے اختیار کو انتہائی احتیاط اور ضبط کے ساتھ استعمال کیا جانا چاہیے---جہاں حقائق کے تمام پہلو مکمل ہوں، مسائل خالصتاً قانونی ہوں، یا اپیل کا ریکارڈ حتمی فیصلے کی اجازت دیتا ہو، اپیلٹ کورٹ کو معاملہ خود طے کرنا چاہیے---ایسے حالات میں کیس ریمانڈ کرنا طریقہ کار کے نام پر انصاف کو تاخیر کا شکار کرنا اور ضابطے کی خاطر اصل مقصد کو قربان کرنا ہے---
غیر ضروری ریمانڈ کے خلاف یہ احتیاط "عدالتی معیشت" (Judicial Economy) کے اصول میں کارفرما ہے—جو جدید عدالتی نظام کا ایک بنیادی اصول ہے جو عدالتوں کو کارروائیوں کی تکرار سے گریز کرنے، فیصلے میں حتمیت لانے اور عدالتی وقت کی بچت کا پابند بناتا ہے---یہ آئین کے آرٹیکل 37(d) کے تحت فوری انصاف کی آئینی ہدایت کی عکاسی کرتا ہے، جس سے یہ یقینی بنایا جاتا ہے کہ مقدمہ بازی تکراری طریقہ کار کے چکروں میں نہ پھنس جائے---عدالتی معیشت تقاضا کرتی ہے کہ جہاں ریکارڈ عدالت کو فیصلہ کرنے کے قابل بناتا ہو، وہاں اپیلٹ کورٹس فیصلہ کریں، نہ کہ التوا میں ڈالیں، کیونکہ تاخیر سے ملا ہوا انصاف، انصاف سے محرومی کے مترادف ہے (Justice delayed is justice denied)۔

عدالتیں، قانون کی حتمی شارح ہونے کے ناطے، ان امور میں لازماً عدالتی ضبط کا مظاہرہ کریں جہاں قانون پالیسی کے اختیار یا انتظامی انتخاب کو کسی ایگزیکٹو یا ادارہ جاتی اتھارٹی کے سپرد کرتا ہے---ادارپاتی خودمختاری کا اصول اس طرح عدالتی حد سے تجاوز (Judicial overreach) کے خلاف تحفظ فراہم کرتا ہے، اس بات کو یقینی بناتا ہے کہ پالیسی بنانا ایگزیکٹو کا ہی حق رہے، اور عدالتیں خود کو قانون کی حدود میں رہتے ہوئے قانونیت، منطق، اور طریقہ کار کی منصفانہ رعایت تک محدود رکھیں۔
حکم (ORDER)
1. کیس کے مختصر حقائق یہ ہیں کہ رسپانڈنٹ، جو پاکستان ریلوے کے آڈٹ ڈیپارٹمنٹ میں بطور اکاؤنٹس آفیسر خدمات انجام دے رہا تھا، نے سال 1992 میں ایل ایل بی کی ڈگری حاصل کر کے اپنی تعلیمی قابلیت میں اضافہ کیا۔ نتیجے کے طور پر، اس نے دو اسکیموں کے تحت دو ایڈوانس انکریمنٹس کے لیے درخواست دی:
"دی انسنٹو اسکیم فار ریلوے آفیسرز اینڈ سب آرڈینیٹس" مورخہ 22.01.1966 ("اسکیم، 1966") جو کہ ریلوے ڈیپارٹمنٹ، حکومتِ مغربی پاکستان کی جانب سے جاری کی گئی تھی؛ اور
"گرانٹ آف ایڈوانس انکریمنٹس ٹو دی ایمپلائز ڈرائنگ پے ان BPS-16"—آفس میمورنڈم مورخہ 08.07.1996 ("جنرل اسکیم، 1996")۔
رسپانڈنٹ نے ایک درخواست کے ذریعے محکمہ سے رجوع کیا، جسے فنانس ڈیپارٹمنٹ کو بھیجا گیا اور بعد ازاں مورخہ 26.09.2019 کے حکم کے ذریعے اس بنیاد پر مسترد کر دیا گیا کہ اسکیم 1966 مورخہ 01.12.2001 کو ختم ہو چکی تھی۔ رسپانڈنٹ نے اس فیصلے کو ٹربیونل کے سامنے چیلنج کیا، جس نے مورخہ 26.10.2022 کے فیصلے کے ذریعے اسے اسکیم 1966 کے تحت ریلیف فراہم کر دیا۔
2. پاکستان ریلوے اور وفاقی حکومت کی نمائندگی کرتے ہوئے فاضل ایڈیشنل اٹارنی جنرل برائے پاکستان نے جناب جواد محمود پاشا (اے ایس سی) اور محترمہ ہما نورین (لیگل کنسلٹنٹ، پاکستان ریلوے) کی معاونت سے موقف اختیار کیا کہ رسپانڈنٹ، آڈٹ ڈیپارٹمنٹ میں اکاؤنٹس آفیسر ہونے کی وجہ سے اسکیم 1966 کے تحت کسی ترغیب (incentive) کا حق دار نہیں تھا۔ فاضل لاء آفیسر نے اسکیم کا حوالہ دیتے ہوئے دکھایا کہ اگرچہ یہ اسکیم پاکستان ریلوے کے مختلف شعبوں کو فوائد فراہم کرتی ہے، لیکن آڈٹ ڈیپارٹمنٹ ان میں شامل نہیں ہے۔ جنرل اسکیم 1996 کے حوالے سے یہ موقف اپنایا گیا کہ مذکورہ اسکیم کے تحت دو ایڈوانس انکریمنٹس کا اہل ہونے کے لیے کسی شخص کے پاس ایم اے (M.A.) یا ایم ایس سی (M.Sc.) کی ڈگری ہونا ضروری ہے۔ چونکہ رسپانڈنٹ کی قابلیت ایل ایل بی ہے، اس لیے وہ اس کے دائرہ کار میں نہیں آتا۔
3. اس کے برعکس، رسپانڈنٹ کے فاضل کونسل نے پرزور دلیل دی کہ ٹربیونل کے متعدد فیصلوں کے ساتھ ساتھ پاکستان ریلوے اور فنانس ڈویژن کے جاری کردہ خطوط کے ذریعے ان افسران کو بھی اسی طرح کے فوائد فراہم کیے گئے ہیں جنہوں نے ایل ایل بی کی ڈگری حاصل کی۔ تاہم، ان میں سے کچھ حوالہ جات ان شعبوں سے متعلق ہیں جو پہلے سے ہی اسکیم 1966 کے تحت شامل ہیں، اور ان میں سے کوئی بھی آڈٹ ڈیپارٹمنٹ کے اکاؤنٹس آفیسر سے متعلق نہیں ہے۔
4. ہم نے فریقین کے فاضل وکلاء کو سنا اور ریکارڈ کا جائزہ لیا ہے۔ دونوں اسکیموں کا غور سے مطالعہ کرنے پر ہم نے پایا کہ اسکیم 1966 کے تحت آڈٹ ڈیپارٹمنٹ کے افسران کو کوئی فائدہ نہیں دیا گیا، اور ایل ایل بی کی قابلیت کو جنرل اسکیم 1996 کے تحت تسلیم نہیں کیا گیا ہے۔ لہٰذا، رسپانڈنٹ کا کیس کسی بھی اسکیم کے دائرہ کار میں نہیں آتا۔ ٹربیونل کی جانب سے اسکیم 1966 کے تحت دیا گیا فائدہ اس طرح ناقابلِ دفاع ہے اور اسے کالعدم قرار دیا جاتا ہے۔
5. جہاں تک جنرل اسکیم 1996 کے تحت رسپانڈنٹ کے متبادل موقف کا تعلق ہے، ٹربیونل نے اس کا احاطہ نہیں کیا۔ ہم نے اس مقصد کے لیے معاملہ ٹربیونل کو واپس ریمانڈ کرنے کے اختیار پر غور کیا۔ تاہم، چونکہ ہمارے سامنے ریکارڈ مکمل ہے اور ہمیں اس معاملے کا حتمی تعین کرنے کے قابل بناتا ہے، اس لیے کیس کو ریمانڈ کرنے کا کوئی جواز نہیں بنتا۔
6. ہم اس بات پر روشنی ڈالنا چاہتے ہیں کہ "ریمانڈ" کوئی خودکار عدالتی ردِعمل نہیں ہے۔ یہ ایک عدالتی طریقہ کار ہے جسے صرف اس وقت استعمال کیا جانا چاہیے جب انصاف کا تقاضا ہو، نہ کہ ایک معمول کے طور پر۔ کسی مقدمے کو نچلی عدالت میں مناسب طور پر اس وقت واپس بھیجا جا سکتا ہے جہاں بنیادی حقائق غیر متعین رہ گئے ہوں، اجرائِی انصاف پر سمجھوتہ ہوا ہو، یا اہم شہادت کا صحیح جائزہ نہ لیا گیا ہو—ایسی صورت حال میں اپیلٹ کورٹ خود مکمل انصاف فراہم نہیں کر سکتی۔ ریمانڈ کا مقصد اصلاحی ہے، التوا کا شکار کرنا نہیں؛ یہ منصفانہ فیصلے کو یقینی بنانے کے لیے ہے، مقدمہ بازی کو طول دینے کے لیے نہیں۔

8. رسپانڈنٹ کے فاضل کونسل کی جانب سے اگلی دلیل یہ دی گئی کہ ایل ایل بی کی ڈگری ایم اے کی ڈگری کے مساوی ہے، لہٰذا رسپانڈنٹ جنرل اسکیم 1996 کے تحت فائدے کا حق دار ہے۔ اس اسکیم میں معادل (equivalent) ڈگریوں کو تسلیم کرنے کی ایسی کوئی سہولت فراہم نہیں کی گئی ہے، اور نہ ہی عدالتی طور پر ایسی شرط کو اس میں شامل کیا جا سکتا ہے۔ ادارہ جاتی خودمختاری آئینی حکومت کاری کا ایک اہم پہلو ہے۔ یہ اس بات کے اعتراف کی عکاسی کرتا ہے کہ ریاست کا ہر رکن یا شعبہ اپنی صلاحیت، مہارت اور اختیار کا ایک دائرہ کار رکھتا ہے جس کے اندر اسے آزادانہ طور پر کام کرنے کی اجازت ہونی چاہیے۔ عدالتیں، اگرچہ قانونیت کی حتمی شارح ہیں، لیکن انہیں ان امور میں عدالتی ضبط کا مظاہرہ کرنا چاہیے جہاں قانون کسی ایگزیکٹو یا ادارہ جاتی اتھارٹی میں پالیسی کے اختیار یا انتظامی انتخاب کو نیہت کرتا ہے۔
9. جب کوئی اسکیم یا محکماتی پالیسی—جیسا کہ پاکستان ریلوے یا فنانس ڈویژن کی طرف سے مرتب کی گئی ہے—صراحت کے ساتھ کوئی خاص فائدہ فراہم نہیں کرتی، تو یہ عدالت کا کام نہیں ہے کہ وہ اس اسکیم میں وہ فائدہ خود شامل کرے۔ ایسا کرنا عدالتی قانون سازی (judicial legislation) کے مترادف ہوگا اور اس ادارہ جاتی خودمختاری کو نقصان پہنچائے گا جو انتظامی افادیت کی بنیادی بنیاد ہے۔ عدالتوں کو اسکیم کی تشریح اسی طرح کرنی ہے جیسے وہ مرتب کی گئی ہے، نہ کہ اپنے سمجھے گئے مساوات یا سہولت کے تصورات کے مطابق اس کی ازسرنو تشکیل کرنی ہے۔
10. اس لیے عدلیہ کو قانون کی مقرر کردہ ادارہ جاتی حدود کا احترام کرنا چاہیے۔ جب تک شکایت کی گئی غفلت/منہا کسی آئینی یا قانونی حکم کی خلاف ورزی نہ کرتی ہو، عدالت کسی ادارے کو ایسی پالیسی اپنانے یا رعایت دینے پر مجبور نہیں کر سکتی جو اس کے اپنے گورننگ فریم ورک میں شامل نہ ہو۔ ادارہ جاتی خودمختاری کا اصول اس طرح عدالتی حد سے تجاوز کے خلاف تحفظ فراہم کرتا ہے، اس بات کو یقینی بناتا ہے کہ پالیسی بنانا ایگزیکٹو کا ہی حق رہے، اور عدالتیں خود کو قانون کی حدود میں رہتے ہوئے قانونیت، منطق، اور طریقہ کار کی منصفانہ رعایت تک محدود رکھیں۔
11. مزید برآں، یہ عدالت پہلے ہی ہولڈ کر چکی ہے (قرار دے چکی ہے) کہ ایل ایل بی کی ڈگری ماسٹرز کی ڈگری کے مساوی نہیں ہے۔ اس سلسلے میں CPLA نمبر 262 آف 2018 بنام "گورنمنٹ تھرو سیکیریٹری فنانس، فنانس ڈویژن، اسلام آباد بمقابلہ منظور قادر، اسسٹنٹ ڈائریکٹر (میلز) وغیرہ" میں پاس کردہ مورخہ 17.02.2022 کے آرڈر، اور CPLA نمبر 65 آف 2017 بنام "دی سیکریٹری فنانس ڈویژن، حکومتِ پاکستان، اسلام آباد بمقابلہ حاکم علی سومرو وغیرہ" میں پاس کردہ مورخہ 13.03.2018 کے آرڈر کا حوالہ دیا جا سکتا ہے۔
12. بالترتیب، ہمیں اس معاملے کو ٹربیونل کو واپس ریمانڈ کرنے کی کوئی وجہ نظر نہیں آتی اور ہم قرار دیتے ہیں کہ رسپانڈنٹ دونوں میں سے کسی بھی اسکیم کے تحت ایڈوانس انکریمنٹس کا حق دار نہیں ہے۔ ہم نوٹ کرتے ہیں کہ فیڈرل سروس ٹربیونل کے متنازعہ فیصلے کے بعد، رسپانڈنٹ کو 75,000 روپے کی رقم ایڈوانس انکریمنٹس کی مد میں پہلے ہی موصول ہو چکی ہے۔ ایڈیشنل سیکریٹری، پاکستان ریلوے کا کہنا ہے کہ، اس کیس کے حقائق و حالات کو مدنظر رکھتے ہوئے، محکمہ رسپانڈنٹ سے مذکورہ رقم واپس وصول کرنے کا ارادہ نہیں رکھتا۔ محکمہ نے اس رقم سے دستبردار ہو کر عالی ظرفی اور سخاوت کا مظاہرہ کیا ہے۔ تاہم، اس ترتیب کو کسی دوسرے کیس میں بطور نظیر (precedent) پیش یا حوالہ نہیں دیا جائے گا۔ ان درخواستوں کو اپیلوں میں تبدیل کر کے منظور کیا جاتا ہے۔

Advance increments on higher qualification---Entitlement---Determination---Applicability of ‘incentive schemes’---Audit department officer holding LLB---Eligibility---Briefly, respondent was serving as an accounts officer in the ‘audit department’ of Pakistan Railways---He acquired an LLB degree in 1992 and thereafter sought grant of two advance increments under the incentive scheme for railways officers and subordinates, 1966, and the ‘general scheme for grant of advance increments, 1996’---Respondent’s representation was rejected by the finance department on the ground that the 1966 Scheme had been abolished and that his qualification did not fall within the 1996 Scheme, whereupon the Federal Service Tribunal allowed his claim under the 1966 Scheme---The issue requiring determination before the Supreme Court was “whether the accounts officer of the ‘audit department’ holding an LLB degree was legally entitled to advance increments under either of the aforesaid schemes”?---Held: No benefit under the Scheme, 1966 had been extended to officers of the audit department, and an LLB qualification was not recognized under the General Scheme, 1996, therefore, the respondent’s case did not fall within the scope of either scheme---The benefit extended by the Service Tribunal under the Scheme, 1966 was thus unsustainable---Moreover, an LLB degree was not equivalent to a master’s degree---Respondent was not entitled to advance increments under either of the schemes---
Employment cases---Remanding of cases---Supreme Court’s view viz remanding the matters on issues not addressed by lower forums---“Remand” is not an automatic judicial reflex, it is a judicial instrument to be employed only when justice so demands, not as a matter of routine---A case may properly be remanded to a lower forum where material facts remain undetermined, procedural fairness has been compromised, or essential evidence has not been duly examined, situations in which the Appellate Court cannot itself do complete justice---The purpose of remand is corrective, not dilatory; it serves to secure a just adjudication, not to prolong litigation---Yet, the power to remand must be exercised with circumspection and restraint---Where the factual matrix is complete, the issues are purely legal, or the appellate record permits a final determination, the Appellate Court ought to decide the matter itself---To remand in such circumstances is to sacrifice substance at the altar of form and to delay justice in the name of process---The restraint against unnecessary remand finds its rationale in the principle of judicial economy, a foundational tenet of modern adjudication that obliges courts to avoid duplication of proceedings, promote finality, and conserve judicial time---It embodies the constitutional command for expeditious justice under Article 37(d) of the Constitution, ensuring that litigation does not get trapped in repetitive procedural rounds---Judicial economy thus demands that appellate courts decide, not defer, where the record enables them to do so, for justice delayed is justice denied.

ORDER
---Brief facts of the case are that the respondent, serving as Accounts Officer in the Audit Department of Pakistan Railways, enhanced his qualification by obtaining an LLB degree in the year 1992. Consequently, he applied for two advance increments under two schemes: (i) THE INCENTIVE SCHEME FOR RAILWAYS OFFICERS AND SUBORDINATES dated 22.01.1966 (“Scheme, 1966”) issued by the Railway Department, Government of West Pakistan; and (ii) GRANT OF ADVANCE INCREMENTS TO THE EMPLOYEES DRAWING PAY IN BPS-16—Office Memorandum dated 08.07.1996 (“General Scheme, 1996”). The respondent approached the department through a representation, which was referred to the Finance Department and subsequently rejected vide order dated 26.09.2019 on the ground that the Scheme, 1966 stood abolished on 01.12.2001. The respondent challenged the said decision before the Tribunal, which, vide impugned judgment dated 26.10.2022, granted him relief under the Scheme, 1966.

Learned Additional Attorney General for Pakistan, representing Pakistan Railways and the Federal Government, assisted by Mr. Jawad Mahmood Pasha, ASC, and Ms. Huma Noureen, Legal Consultant, Pakistan Railways, submits that the respondent, being an Accounts Officer in the Audit Department, was not entitled to any incentive under the Scheme, 1966. Learned Law Officer referred to the scheme to show that while it extends benefits to various departments of Pakistan Railways, the Audit Department is not one of them. With regard to the General Scheme, 1996, it was submitted that the said scheme requires a person to possess an M.A. or M.Sc. degree to qualify for two advance increments. As the respondent’s qualification is LLB, he does not fall within its ambit.

Conversely, learned counsel for the respondent vehemently argued that several judgments of the Tribunal, as well as letters issued by Pakistan Railways and the Finance Division, have extended similar benefits to officers who obtained an LLB degree. Some of these references, however, relate to departments already covered under the Scheme, 1966, and none pertains to an Accounts Officer of the Audit Department.
4. We have heard the learned counsel for the parties and examined the record. Upon careful perusal of both schemes, we find that no benefit under the Scheme, 1966 has been extended to officers of the Audit Department, and that an LLB qualification is not recognized under the General Scheme, 1996. Therefore, the respondent’s case does not fall within the scope of either scheme. The benefit extended by the Tribunal under the Scheme, 1966 is thus unsustainable and stands set aside.
5. As to the respondent’s alternate plea under the General Scheme, 1996, the Tribunal did not address it. We considered the option of remanding the matter to the Tribunal for this purpose. However, since the record before us is complete and enables us to finally determine the issue, there is no occasion to remand the case.
6. We wish to highlight that “Remand” is not an automatic judicial reflex. It is a judicial instrument to be employed only when justice so demands, not as a matter of routine. A case may properly be remanded to a lower forum where material facts remain undetermined, procedural fairness has been compromised, or essential evidence has not been duly examined—situations in which the appellate court cannot itself do complete justice. The purpose of remand is corrective, not dilatory; it serves to secure a just adjudication, not to prolong litigation.
7. Yet, the power to remand must be exercised with circumspection and restraint. Where the factual matrix is complete, the issues are purely legal, or the appellate record permits a final determination, the appellate court ought to decide the matter itself. To remand in such circumstances is to sacrifice substance at the altar of form and to delay justice in the name of process. The restraint against unnecessary remand finds its rationale in the principle of judicial economy—a foundational tenet of modern adjudication that obliges courts to avoid duplication of proceedings, promote finality, and conserve judicial time. It embodies the constitutional command for expeditious justice under Article 37(d) of the Constitution, ensuring that litigation does not get trapped in repetitive procedural rounds. Judicial economy thus demands that appellate courts decide, not defer, where the record enables them to do so, for justice delayed is justice denied.
8. It was next argued by learned counsel for the respondent that an LLB degree is equivalent to an M.A. degree, hence the respondent is entitled to benefit under the General Scheme, 1996. No such facility for treating equivalent degrees is provided in the scheme, nor can such a condition be judicially read into it. Institutional autonomy is a vital facet of constitutional governance. It reflects the recognition that each organ or department of the State possesses its own sphere of competence, expertise, and discretion within which it must be permitted to function freely. Courts, while the ultimate interpreters of legality, must exercise judicial restraint in matters where the law vests policy discretion or administrative choice in an executive or institutional authority.
9. When a scheme or departmental policy—such as one framed by Pakistan Railways or the Finance Division—does not expressly provide for a particular benefit, it is not the function of the Court to read that benefit into the scheme. Doing so would amount to judicial legislation and would erode the institutional autonomy that underpins administrative efficacy. Courts are to interpret the scheme as framed, not to re-engineer it according to perceived notions of equity or convenience.
10. The judiciary must therefore respect the institutional boundaries drawn by law. Unless the omission complained of violates a constitutional or statutory command, the Court cannot compel an institution to adopt a policy or grant a concession not contemplated by its own governing framework. The principle of institutional autonomy thus guards against judicial overreach, ensuring that policy formation remains the prerogative of the executive, and that courts confine themselves to ensuring legality, rationality, and procedural fairness within the limits set by law.
11. Furthermore, this Court has already held that an LLB degree is not equivalent to a Master’s degree. Reference may be made to order dated 17.02.2022 passed in CPLA No. 262 of 2018 titled Government through Secretary Finance, Finance Division (Regulation Wing), Islamabad v. Manzoor Qadir, Assistant Director (Mails) and others, and order dated 13.03.2018 passed in CPLA No. 65 of 2017 titled The Secretary Finance Division, Government of Pakistan, Islamabad v. Hakim Ali Soomro and others.
12. Accordingly, we see no reason to remand the matter to the Tribunal and hold that the respondent is not entitled to advance increments under either of the Schemes. We note that, following the impugned judgment of the Federal Service Tribunal, the respondent has already received advance increments amounting to Rs. 75,000/-. The Additional Secretary, Pakistan Railways, submits that, in the facts and circumstances of this case, the Department does not intend to recover the said amount from the respondent. The Department has shown grace and magnanimity in foregoing this amount; however, this arrangement shall not be treated or cited as a precedent in any other case. The instant petitions are converted into appeals and allowed.
