اگر کسی خاتون نے عدالت سے خلع کی ڈگری حاصل کر لی ہو تو یہ ایک حتمی اور مؤثر عدالتی فیصلہ ہوتا ہے، جس کے بعد قانونی طور پر ازدواجی تعلق ختم تصور کیا جاتا ہے؛ بعض اوقات خلع کی ڈگری فوراً یونین کونسل میں جمع نہیں کروائی جاتی اور مہینوں یا حتیٰ کہ ایک سال یا اس سے زیادہ وقت گزر جاتا ہے، ایسی صورت میں بھی قانون خاتون کو طلاق مؤثر / ڈائیورس سرٹیفکیٹ حاصل کرنے کا حق دیتا ہے۔ خلع کی ڈگری کی بنیاد پر متعلقہ یونین کونسل میں قانونی کارروائی مکمل کی جاتی ہے، نوٹس پراسیس اور ریکارڈ کی جانچ کے بعد باقاعدہ ڈائیورس سرٹیفکیٹ جاری کیا جاتا ہے؛ چاہے شوہر بیرونِ ملک ہو، غیر حاضر ہو، یا آپس میں علیحدگی خفیہ طور پر ہو چکی ہو، تاخیر ہونے کے باوجود درست دستاویزات، عدالتی ڈگری اور قانونی طریقہ کار کے ساتھ طلاق سرکاری طور پر رجسٹرڈ ہو جاتی ہے، جو NADRA ریکارڈ، شناختی کارڈ میں تبدیلی، دوبارہ نکاح، امیگریشن اور دیگر قانونی مقاصد کے لیے مکمل طور پر قابلِ قبول ہوتی ہے
After obtaining a Khula Degree from the Court, the marital relationship legally comes to an end as the Khula Decree is a final and effective court order; in many cases, the Khula Degree is not submitted to the Union Council immediately and months or even a year may pass, however, even after such delay, a woman is fully entitled to obtain an Effective Divorce / Divorce Certificate under the law. On the basis of the Khula Degree, the required legal process is completed at the concerned Union Council, and after notices and verification, an official Divorce Certificate is issued; this remains valid even if the husband is abroad, absent, or the separation was kept undisclosed, and upon completion of proper documentation and legal procedure, the divorce becomes officially registered and acceptable for NADRA record update, CNIC correction, remarriage, immigration, and all other legal purposes.
