Agar joint/unpartitioned property mein ek co-sharer apna hissa sell kar de, to kya buyer automatically kisi specific jagah ka exclusive owner ban jata hai? 🤔

Lahore High Court — PLD 2023 Lahore 503 ne is important legal principle ko explain kiya:

📌 Buyer ko utne hi rights milte hain jitne seller ke paas thay — na zyada, na kam.

Agar seller joint property ke kisi specific portion par possession mein tha aur wahi possession buyer ko transfer ki, to actual partition hone tak buyer us possession ko retain kar sakta hai.

Lahore High Court ne 2026 YLR 1912 — Muhammad Riaz v. Mst. Najma Bibi & others mein ek important principle clarify kiya:

Agar koi shakhs yeh claim kare ke deceased ne property usay oral gift kar di thi, to sirf daawa kar dena kaafi nahi. Gift ko credible evidence se prove karna zaroori hai.

Court ne yeh bhi observe kiya ke mutation khud title ka document nahi hoti aur jab gift transaction hi disputed ho, to beneficiary par usay prove karne ka burden hota hai.
