An Area Magistrate plays a vital role in maintaining law and order while ensuring the smooth administration of justice. Under the Code of Criminal Procedure (CrPC), 1898, a Magistrate is empowered to hear criminal cases, grant bail, issue warrants, and oversee investigation processes through remand proceedings.

Types of Benches in High Court ⚖️

In the High Court, cases are heard by different benches depending on the nature, importance, and complexity of the matter.

A Single Bench consists of one judge and usually deals with routine matters such as bail applications, writ petitions, and civil or criminal cases.

A Division Bench, comprising two judges, hears appeals against decisions of a Single Bench and important legal or constitutional issues.

A Full Bench includes three or more judges and is formed to decide significant questions of law or to resolve conflicting judgments.

A Larger Bench is constituted in cases of great public importance or when previous rulings need reconsideration, ensuring authoritative and final interpretation of law.

Mere allegations and adverse remarks in an inquiry report are not sufficient to declare a government employee guilty. Unless there is credible evidence available on record proving misconduct, the employee shall be presumed innocent in accordance with the principles of justice, fairness, and due process of law. An important judgment by the Supreme Court of Pakistan has reaffirmed that a government employee cannot be dismissed from service merely because he was sentenced to imprisonment in a civil case. Know your constitutional and legal rights. No police officer or investigating agency, including CCD, can illegally detain, torture, or implicate any citizen without due process of law. Always keep your family informed about your whereabouts, immediately contact a lawyer in case of detention, avoid signing blank papers or forced confessions, and demand production before a Magistrate within the legal time. Record details of arresting officials, preserve call records/messages, and seek legal remedies such as habeas corpus petitions, bail, and constitutional petitions under Article 199 whenever fundamental rights are violated. Awareness of law is the strongest protection against illegal custody, fake encounters, and misuse of authority.

A chance witness is a person who is not a natural or expected witness of an occurrence but happens to be present at the scene of the incident by coincidence or accident and later testifies about what they saw. In legal proceedings, especially in criminal trials, the testimony of a chance witness is not rejected outright; however, it is examined with great caution. Courts assess whether the presence of such a witness at the place of occurrence is natural, plausible, and satisfactorily explained. If the statement of a chance witness is consistent, truthful, and corroborated by other independent evidence, it can be relied upon. However, if their presence appears doubtful, unexplained, or unnatural, their evidence may be discarded as unreliable.

Under family law principles, if biological parents voluntarily give their child in adoption to another person, they may lose their right of custody (hizanat). Such conduct is often interpreted as a conscious relinquishment of their custodial rights, especially when the child has been permanently placed under the care and upbringing of another family.

However, this is not an absolute rule. Courts, particularly in jurisdictions like Pakistan, decide custody matters primarily on the principle of welfare of the minor. Therefore, even if the parents had previously given the child for adoption, they may reclaim custody if it is proven that the welfare of the child demands such a change.

Thus, while voluntary adoption can weaken or even extinguish the claim of biological parents to custody, the ultimate consideration remains the best interest and well-being of the child.

Lahore High Court Grants Pension Rights to Long-Term Ad Hoc Employees
The Lahore High Court, in its recent judgment, has held that an employee who has been working on an ad hoc basis for a prolonged period shall be deemed to have been regularized automatically. Such employees are entitled to pension and all other retirement benefits on par with regular employees at the time of retirement. The holding of an identification parade is not a mandatory legal requirement in every case. Under Article 22 of the Qanun-e-Shahadat Order, 1984, any fact, in whatever form, that establishes the identity of an accused person is deemed relevant and admissible. In the present case, the petitioners (accused persons) were clearly visible in CCTV camera recordings, which effectively established their identity. Such footage constitutes admissible evidence under Article 22. Furthermore, the same is also relevant under Article 164 of the Qanun-e-Shahadat Order, 1984, as it represents evidence obtained through modern devices, subject to verification of its genuineness and authenticity.

In view of the availability of this reliable and direct evidence, the necessity of conducting an identification parade is rendered redundant.

Vehicle Superdari – Supreme Court Clarification

The Supreme Court of Pakistan has authoritatively clarified the legal position regarding the release of vehicles on Superdari (interim custody) under Section 516-A CrPC.

The Court held that granting interim custody of a vehicle does not prejudice the trial proceedings, nor does it amount to acquittal or a “clean chit” for the accused. It also does not exempt the owner or recipient of the vehicle from ongoing legal proceedings.

The duration of Superdari remains subject to the ex*****on of bonds and surety, and it may continue until the final decision of the case. During this period, the person entrusted with custody is legally bound to:

Appear before the Court or Investigating Officer when required

Participate in all legal proceedings

Produce the vehicle as and when directed by the Court

In Civil Petition No. 256-K of 2024, the Supreme Court further emphasized that applications under Section 516-A CrPC must be decided expeditiously, after providing a fair opportunity of hearing and supported by cogent reasons.

The judgment also reinforces fundamental rights under Articles 23 and 24 of the Constitution, ensuring protection of property while maintaining the integrity of criminal proceedings.
