وکیل کے ساتھ بدتمیزی کرنے والے جج کے لیے سزا

اگر کوئی جج کسی وکیل کی بے عزتی کرتاہے تو وہ اسی عدالت کی توہین کا مرتکب ہوتا ہے اور اسکی خلاف توہین عدالت کی کاروائی کرکے سزا دلوائی جاسکتی ہے

ایک مقدمہ اے آئی آر (AIR)1949 کے صفحہ نمبر470 پر لاہور ہائیکورٹ نے قرار دیا ہے کہ اگر کوئی جج کسی وکیل کے بے عزتی کرتا ہے تو توہین عدالت کا مرتکب ہوگا

مذکورہ بالا مقدمہ کے حقائق کچھ اسطرح ہیں کہ مجسٹریٹ نے بھری عدالت میں وکیل کو بے وقوف کہا تھا جس پر وکیل نے مجسٹریٹ کے خلاف کاروائی کی تھی اور مجسٹریٹ کو قید کی سزا ہوئی تھی

اس سزا کو مجسٹریٹ نے ہائیکورٹ چیلنج کیا تھااور موقف لیا تھا کہ اسکا یہ عمل توہین عدالت کے ذمرہ میں نہیں آتا مگر ہائیکورٹ نے بھی فیصلہ کو برقرار رکھتے ہوے قرار دیا تھا کہ وکلاء آفیسر آف دی کورٹ ہیں لہذا اگر کوئی جج وکیل کی بے عزتی کرے گاتو توہین عدالت کا مرتکب ہوگا

لاہور ہائی کورٹ کا یہ فیصلہ اب کیس لاء کی شکل اختیار کرچکا ہے اور صرف پاکستان ہی نہیں بلکہ انڈیا میں بھی عدالتوں میں بطور ریفرنس استعال ہورہا ہے

دہلی ہائیکورٹ نے بھی اسی فیصلہ کو ریفرنس استعمال کرتے ہوے اپنے فیصلہ 1984(سی آر ایل جے) کے صفحہ نمبر 481 پر قرار دیاہے کہ وکلاء کو ججز کے رویہ پر ہڑتال کرنے کی بجاے ججز کے خلاف توہین عدالت کی پیٹیشن دائر کرنی چاہیے

If a judge insult an advocate then he is guilty of contempt of court, reliance is placed in AIR 1949 Lahore 470

Section 298- B
PAKISTAN PENAL CODE

(1) Any person of the Quadiani group or the Lahori group (who call themselves 'Ahmadis' or by any other name) who by words, either spoken or written, or by visible representation,
(a) refers to, or addresses, any person, other than a Caliph or companion of the Holy Prophet Muhammad (peace be upon him), as 'Ameer-ul-Mumineen,' 'Khalifa-tul-Mumnineen', Khalifa-tul-Muslimeen, 'Sahaabi' or 'Razi Allah Anho';
(b) refers to, or addresses, any person, other than a wife of the Holy Prophet Muhammad (peace be upon him), as 'Ummul-Mumineen';
(c) refers to, or addresses any person, other than a member of the family (Ahle-bait) of the Holy Prophet Muhammad (peace be upon him), as Ahle-bait; or
(d) refers to, or names, or calls, his place of worship as 'Masjid':
shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine.
(2) Any person of the Quadiani group or Lahori group (who call themselves 'Ahmadis' or by any other name) who by words, either spoken or written, or by visible representation, refers to the mode or form of call to prayers followed by his faith as 'Azan', or recites Azan as used by the Muslims, shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine.

SECTION 498-A PPC
Prohibition of depriving woman from inheriting property

Whoever by deceitful or illegal means deprives any woman from inheriting any movable or immovable property at the time of opening of succession shall be punished with imprionment for either description for a term which may extend to ten years but not be less than five years or with a fine of 1 million rupees or both

SECTION 509 OF PAKISTAN PENAL CODE . Word ,Gesture or Act Intended to INSULT THE MODESTY of A WOMAN.
(Whoever Intending To Insult the modesty of any woman, utters any words, makes any sounds or gestured or Exhibits any object ,Intending That Such Word Or Sound Shall Be Heard, oR That Such Gesture Or Object Shall Be Seen By Such Woman ,or intrudes Upon the privacy of such Woman ,Shall Be Punished with Simple Imprisonment for a term which May extend to Three years , Or with Fine of 500,000 (5 lakh rupees) ,Or With both.

Section 375 of PPC provides five categories of r**e: (1) sexual in*******se with a woman against her will; (2) sexual in*******se without the consent of the woman; (3) sexual in*******se with woman’s consent obtained by way of placing the woman under the fear of death or hurt; (4) sexual in*******se with the woman’s consent when the man knows that he is not her husband and that her consent is given because she believes herself to be lawfully married; and (5) sexual in*******se with or without the woman’s consent if she is under 14 years of age.

Section 182 of Pakistan Penal Code-PPC | False information with intent to cause public servant to use his lawful power to the injury of another person:
Whoever gives to any public servant any information which he knows or believes to be false, intending thereby to cause, or knowing it to be likely that he will thereby cause, such public servant :-
(a)to do or omit anything which such public servant ought not to do or omit if the true state of facts respecting which such information is given were known by him, or
(b)to use the lawful power of such public servant to the injury or annoyance of any person,
shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to 64[three thousand rupees] 64, or with both.
Illustrations
(a)A informs a Magistrate that Z, a police-officer, subordinate to such Magistrate, has been guilty of neglect of duty or misconduct, knowing such information to be false, and knowing it to be likely that the information will cause the Magistrate to dismiss Z. A has committed the offence defined in this section.

(b)A falsely informs a public servant that Z has contraband salt in a secret place, knowing such information to be false, and knowing that it is likely that the consequence of the information will be a search of premises, attended with annoyance to Z. A has committed the offence defined in this section.

(c)A falsely informs a policeman that he has been assaulted and robbed in the neighbourhood of a particular village. He does not mention the name of any person as one of his assailants, but knows it to be likely that in consequence of their information the police will make enquiries and institute searches in the village to the annoyance of the villagers or some of them. A has committed an offence under this section.
