The Supreme Court of Pakistan has ruled that secretly recording private conversations without the person’s consent, including taking screenshots of chats, video calls, saving snaps, etc., especially for illegal purposes like extortion, is a criminal offense under Pakistani law.

The judgment, written by Justice Muhammad Hashim Khan Kakar, highlighted that unauthorized recordings violate the Prevention of Electronic Crimes Act (PECA) 2016 and fundamental constitutional rights, including privacy and human dignity.

The court emphasized that secret recordings cannot be used in legal proceedings and distinguished between official duty recordings and those made to trap someone. Referring to Islamic principles, the verdict cited the Quranic command, “Do not spy,” reinforcing the sanctity of private life.

The court warned that allowing unauthorized surveillance could undermine constitutional protections and create a society dependent on illegally obtained evidence.
