لاہور ہائیکورٹ نے مجسٹریٹس کو پہلی بیوی کی بلااجازت دوسری شادی کرنے والے شوہروں کے ٹرائل سے روک دیا۔

دوسری شادی کرنیوالے ملزم شوہروں کے ٹرائل سے متعلق لاہور ہائیکورٹ کے جسٹس امجد رفیق نے بڑا فیصلہ جاری کردیا۔

جسٹس امجد رفیق نے قانونی نکتہ طے کردیا کہ پنجاب بھر کے مجسٹریٹس پہلی بیوی کی اجازت کے بغیر دوسری شادی کرنے والے ملزم شوہر کے ٹرائل نہیں کر سکتے۔ ہائیکورٹ نے پنجاب بھر کے مجسٹریٹس کو دوسری شادی کے کیسز کے ٹرائل کرنے سے روک دیا۔
فیصلے میں کہا گیا کہ فیملی کورٹ کے 1964 کے ایکٹ کے سیکشن 20کے تحت صرف فیملی عدالتوں کو مسلم فیملی لا آرڈیننس کے کیسز سننے کا اختیار ہے، مجسٹریٹس کی جانب سے ایسے کیسز کا ٹرائل کرنا آئین کے آرٹیکل 175 کے سب سیکشن (2) کی خلاف ورزی ہے۔
ہائیکورٹ نے پہلی بیوی کی اجازت کے بغیر دوسری شادی کرنے والے شوہر کی سزا کے خلاف اپیل پر فیصلہ سنادیا۔ جسٹس امجد رفیق نے پانچ صفحات پر مشتمل تحریری فیصلہ جاری کیا۔

ملزم مظفر نے پہلی شادی عشرت بی بی کے ساتھ 2ستمبر2013 کو کی تھی، مظفر نے پہلی بیوی کی اجازت کے بغیر 4اپریل2015کو ستارہ جبیں سے دوسری شادی کرلی، پہلی بیوی کی اجازت کے بغیر دوسری شادی کرنے پر مجسٹریٹ نے مظفر کو 3ماہ قیداور 5لاکھ روپے جرمانہ کی سزا سنادی، مجسٹریٹ نے ٹرائل کرکے اختیارات سے تجاوز کیا۔

لاہور ہائیکورٹ نے بغیر اجازت دوسری شادی کرنے والے شوہر کا مجسٹریٹ کی جانب سے ٹرائل کرنا کالعدم قرار دیدیا۔ عدالت نے ملزم مظفر کی تین ماہ قید اور 5لاکھ روپے جرمانہ کی سزا بھی کالعدم قرار دیدی ۔

فیصلے کے مطابق پہلی بیوی کی اجازت کے بغیر دوسری شادی کرنے پر پہلی بیوی نے استغاثہ دائر کیا، مجسریٹ نے مسلم فیملی لاء کے سیکشن 6کے تحت شوہر کو سزاسنائی، ایڈیشنل سیشن جج نے بھی اپیل کنندہ کی سزا برقرار رکھنے کا حکم دیا۔

اپیل کنندہ کے وکیل نے موقف اختیار کیا مسلم فیملی لاء آرڈیننس کے تحت صرف فیملی کورٹ کو کیس سننے کا اختیار تھا، جوڈیشل مجسٹریٹ کو سماعت کا اختیار نہیں تھا لہذا سزا بھی کالعدم قرار دی جائے۔

عدالت نے فیصلے میں کہا کہ مسلم فیملی لاء آرڈیننس کے سیکشن 5 میں لفظ (ایکسکلوزیو) کا مطلب فیملی کورٹ کے علاوہ کوئی دوسری عدالت اسکے اختیارات استعمال نہیں کرسکتی، یہ بات واضح ہے کہ صرف فیملی کورٹ کو ہی اس نوعیت کے جرائم پر سماعت کرنے کا اختیار ہے ۔ سیکشن 20کے تحت فیملی کورٹ کو فرسٹ کلاس مجسریٹ کے اختیاراتِ دیے گئے ہیں، لہذا مجسریٹ کاسزا دینے اور ایڈیشنل سیشن جج کا سزا برقرار رکھنے کا فیصلہ کالعدم قرار دیا جاتا ہے۔......

Khula for the overseas Pakistani woman living abroad can file khula to get divorce from family court Pakistan. She must have to adopt some step to fulfill the legal requirement of legal procedure. Under Muslim Family laws.
(i) She must execute a special power of attorney nominating any person as her personal attorney / representative. This power of attorney will be attested from Embassy of Pakistan or Pakistan High Commission in the country of her stay. It must be attested from the Ministry of Foreign Affairs in Pakistan.
(ii) The Special attorney nominated by the wife should have power to represent her, will appoint a lawyer and sign the documents on her behalf for khula proceedings in the family court.
(iii) The personal representative then can file a case, appear before the family case on behalf of wife through a lawyer, in a family court for obtaining khula decree.
(iv) After obtaining Khula decree and judgment the special attorney can start proceeding in Arbitration Council can be initiated for obtaining Divorce Certificate. Keep in mind for arbitration special attorney have permission for overseas wife to appear and proceed through special power of attorney.

ماں نے اقرارنامہ تحریر کر کے دے دیا کہ وہ خلع کے عوض بچے کی حضانت کے حق سے دستبردار ھوتی ھے۔ سپریم کورٹ آف پاکستان نےآج مورخہ 17 جولائی 2020 کے فیصلہ میں ایسے معاہدہ کو سراسر غیر شرعی اور غیر قانونی قرار دے کر بچہ باپ سے لیکر ماں کے حوالے کرنے کا حکم صادر فرمایا۔
اور مزید قرار دیا کہ ماں جتنی بھی لاچار، غریب یا معذور ہو اسے حق حضانت سے محروم نہیں رکھا جا سکتا ...!!!

The opinion of a Police Officer who has investigated the case as to the guilt or innocence of an accused person is not a relevant fact, and is therefore not admissible, under the Qanun-eShadat Order, 1984; as he is not an “expert” within the meaning of that term as used in Article 59 of the Qanun-e-Shadat Order, 1984. Even the Criminal Procedure Code (Cr.P.C) does not authorize him to form such an opinion. To determine guilt or innocence of an accused person alleged to be involved in the commission of an offence is a judicial function that can only be performed by a court of law. This judicial function cannot be delegated to the Police Officer investigating the case. The Police Officers are empowered under the provisions of Chapter XIV of the Cr.P.C, only to investigate the non-cognizable offence with the order of a Magistrate and the cognizable offence without such order. This power of investigation, in no way, includes the power to determine guilt or innocence of the accused persons. An investigation, as defined in Section 4(1)(l) of the Cr.P.C, includes all proceedings under the Cr.P.C for the collection of evidence conducted by a Police Officer or by any other person authorized by a Magistrate. This definition makes it clear that the assignment of a Police Officer conducting an investigation is limited to the collection of evidence, and the evidence when collected has to be placed by him before the competent court of law. Only the court has the power and duty to form an opinion about the guilt or innocence of an accused person and to adjudicate accordingly on the basis of evidence produced before it. An opinion formed by the investigating officer as to the non-existence or existence of sufficient evidence or reasonable ground of suspicion to justify the forwarding of an accused person to a Magistrate under sections 169 and 170 of the Cr.P.C does not tantamount to opinion as to the guilt or innocence of the accused person. And despite such opinion of the investigating officer, the final determination even as to the existence or non-existence of sufficient ground for further proceeding against the accused person is to be made by the Magistrate under Section 173(3) and 204(1) of the Cr.P.C on examining the material available on record, and not on the basis of that opinion of the investigating officer.3 Therefore, the reference to and reliance on the opinion of the investigating officer by the High Court in its judgment was also legally untenable.
