Whether the Civil Court has parallel jurisdiction to the High Court to refer parties to foreign-seated arbitrations is a question still under debate in Pakistan. In this regard, the judgment in the Tradhol case by the Lahore High Court stands on one side, and three judgments by the Islamabad High Court, with a recent one by the Sindh High Court, stand on the other. The controversy between the judgments would best be resolved by the Honourable Supreme Court of Pakistan in any appropriate case. However, according to a scholarly opinion, the point of view taken in the Tradhol Case outweighs those of the Islamabad High Court and the Sindh High Court.
