In the context of child’s custody, the term hadanah (custody) refers to the upbringing of minor child by the mother or by someone who is legally entitled to it. It includes protection, love and care, education, sheltering, management of a child and etc. The practice in the Shariah seems to suggest that the court applied the principle of maslahah (interest) of the child and this has become the overriding principle in deciding the right of the custody. Hence, the interest of a child as a paramount consideration in awarding child’s custody will always be upheld.... to be continued!
