The civil law system in Pakistan is derived from the British common law system and is based on a set of statutes that provide for the settlement of civil disputes. The following is a general procedure for civil lawsuits in Pakistan:
1. Pre-filing stage: A lawyer is consulted by the plaintiff and a claim is drafted outlining the complainant's case. The claim is then filed in the relevant district court.
2. Summon to Defendant and written statement: after filling of claim the court will issue summon to defendant after appearing of defendant a copy of claim is served on the defendant and than he will submit w/s in his support.
3.Pleading stage: Both parties present their claims and counterclaims in writing, along with supporting documents and evidence that is relevant to the case.
4.Evidence stage: During this stage, both sides may request documents or evidence from the other party. They may also conduct cross examination with relevant parties.
5. Trial stage: If the case proceeds to trial, evidence is presented, arguments are made, and a verdict is reached.
6. Judgment stage: Once the verdict is reached, the judge issues a written judgment, outlining the decision and any awarded damages.
7. Appeal stage: Either party may appeal the court's decision to a higher court.
