Legal Update: Pakistan has enacted the Parents Protection Ordinance 2021, which aims to protect parents from forced evictions by their children even if the house is owned/rent is paid by the children. Issued under article 89 of the constitution, the ordinance states that while children cannot evict parents, parents can serve a written notice to the children to vacate the house if it belongs to them (the parents). Failure to vacate will result in a one-month imprisonment and fine or both along with an intervention by the authorities who will force an eviction. Once, arrested the individuals will be presented before a magistrate court and the right to appeal will be reserved by both parties.

Do you ever wonder why in our country people tend to hesitate to help others after car accidents or in other emergency situations? An absence of appropriate laws can explain this question and a myriad of other morally degrading positions of our society. While it is true that laws do not dictate morality, they do tend to shape it. In Pakistan, nearly 2.6 percent of deaths are caused by post-accident neglect. Our rescue response is inefficient, but another layer that factors into this tragedy is the hesitancy of bystanders to get involved. This likely results from the fact that Pakistan does not have anything akin to Good Samaritan Laws which aim to protect well-intentioned citizens from liability in failed rescue attempts. The Punjab Emergency Services Act 2006 comes close to being something similar; however, it only relieves rescue workers from liability. Hence, the problem persists; the layman refuses to help in fear of being held accountable if the rescue effort is unsuccessful. However, the lack of such laws in Pakistan takes into consideration the fact that often untrained help can be deathly, as, unlike rescue workers, the common person does not know what immediate response will be the best. But in a country like ours, where rescue services lack the resources to make it to emergencies in time, this consideration is perhaps not the most helpful in the long run. So as we progress, we can hope to one day have laws in Pakistan that make it easier for people to do the right thing.

On the 8th of March every year, countless movements around the world unite to push forward towards a more equal future for women as a whole and as a result of these efforts we have made great strides for the cause of greater rights for women but we still have a long way to go. This women’s day do not only appreciate the women in your homes in their roles as mothers, sisters and wives but take a moment to appreciate them as fellow human beings. Give unconditional respect to them that is not tied to the role they have in your life and join the fight for the rights of women everywhere.

The law sees women as equal citizens and attempts to more accurately materialize this concept in our society with every amendment that is made to it and it is our duty to uphold the rights that are provided by it and to work towards making a better, safer and more dignified society for women to exist in.

Legal Update: Yesterday (on the 24th of February, 2021) , the NA passed a bill banning corporal punishment and amending Section 89 of the Pakistan Penal code which had previously allowed guardians and teachers to administer physical punishment on children under the guise of it being for their benefit. This bill and amendment seek to no longer grant abusive adults this loophole.

Legal Update: After a long-awaited process of demanding justice for those impacted by enforced disappearances of their loved ones, Prime Minister Imran Khan has finally demanded the law on enforced disappearances to be passed.

In 2019, Zulfiqar Shah, joint director at the Pakistan Institute of Labour, Education and Research (Piler), had spoken to Dawn and stated that “Out of the total 6,474 complaints officially received by the Commission of Inquiry on Enforced Disappearances till Nov this year, 3,434 people have been freed whereas 2,206 cases are still pending. We would like to know what legal action has been taken against the perpetrator/s of these cases. There is no law to punish the persons involved in such crimes.”

The call to action is finally close to being heard and we at Saeed and Moeez are looking forward to such development of the law, which aims to strive better to protect the citizens of Pakistan.

As the world rapidly becomes more and more reliant on cyberspace, laws have to step in to protect citizens from crimes committed via these channels. On August 11, 2016, Pakistan’s National Assembly, passed a cybercrime law called the Prevention of Electronic Crimes Act, 2016. The Act, among offenses related to cyberterrorism, also includes a crime of spamming malicious code, and criminalizes defamation “through any information system or devices.” Hence it aims to provide greater protection to citizens who might be victims of the circulation of intimidating and defamatory content.
